Winnipeg Free Press (Newspaper) - December 21, 1875, Winnipeg, Manitoba Tic boundaries of Ontario. From the Globe. Two of the boundaries of. This province Are at present in dispute an j. Negotiations of which the result is. As yet undetermined have f6r some time been carried on Between the various parties interested with a View to arrive at a satisfactory settlement of the question. The disputed boundaries Are that on the extreme West Between the province of Ontario and what is known As the North West territory and that on the North be tween Ontario and the Hudson s Bay Terri tories. Two reports have just been presented to the Ontario legislature embodying the views of two Independent commissioners respecting the proper location of these disputed boundaries. These documents arc voluminous and exhaustive and Are All the More valuable As magazines of information on the subject on account of their Independence of each other As Well As the fact that the commissioners approached the inquiry from entirely different sides. A Brief digest of the two reports which is All that we can Lay before our readers just now will at least put them in Possession of the conclusions arrived at and May perhaps afford some idea of the method by which those conclusions have been reached. The earliest of the two is that by or David Mills m a who received his appointment in March 1872, and completed his labors during the course of the same year though the report is now made Public for the first time. The various Points which lie claims to have settled by his investigations Are thus summed up by from the facts which 1 have stated in the foregoing pages it is Clear that new France extended Westward to the Blocky mountains if not to the Pacific Ocean that of this territory the province of Quebec included All eastward of the Mississippi to its Lead Waters and from thence to the Hud sons s Bay territories it included All cast Ward of a Lino drawn from the source of the Mississippi far to the Westward to embrace All the French settlements and posts in the North West Fiat is to the Forks of the Saskatchewan that by the order in Council of 1791, All that part of Canada to its utmost limits West of the Boun Dary Between upper and lower Canada is declared to be included in upper Canada. This would extend the Boundary on the West to the Blocky mountains. It would carry the Boundary of the province Westward beyond the limits of Quebec under the act of 1774, and where that order in Council placed the Boundary it in my opinion still re Mains. The commission to lord Dorchester extended his authority Over so much of upper Canada As was included in the pro Vince of Quebec As altered by the treaty of 1783 and the limits of which Are set Forth in the commission of 1786. I have no doubt but that the province of Manitoba has been formed within the Legal limits of Ontario. It is to be regretted that no protest was made by the government of Ontario at the time that Manitoba was being in discussing the question before him or. Mills May certainly be said to have begun at the beginning. His plan is to establish correctly the Southern Boundary first of the French province of Canada prior to its surrender to great Britain and secondly of the British province As Laid Down in the treaty of Paris of 17s3. The Princi pal authority on the question of this South Ern Boundary is the act passed by the Imperial parliament in 1774, and known As the Quebec act. Had the meaning of the Boundary clause in Chat act been capable of one interpretation the present disputes could never have Arisen or if they had they could easily have Boon settled. But that clause has been differently interpreted by different authorities and in consequence province of Quebec As created and established by the said Royal proclamation of the 7th of october 1763." the meaning of this Section of the act in so far As the present Boundary question is concerned turns mainly on the scope and connection of term its connection becomes More apparent when the detailed description of the Southern Boundary is omitted from the Section which of Dkl then read that All the territories islands and countries in North America belonging to the Crown of great Britain bounded on the South by a line from the Bay of to the Banks of the Mississippi and North Ward to the Southern Boundary of the territory granted to the merchants Advent Urcis be and they Are hereby Dur ing his majesty s pleasure annexed to and made part and parcel of the province of it has been argued by some interpreters of the Quebec act that the term northward Here applies to the Boundary line which after striking the mis turn northward till it reaches the Southern Boundary of the Hudson s Bay territories following either a Meridian line due North or adapting itself to the meanderings of the River which would in that Case form the Boundary As far As its source. The View taken by or Mills is that the term northward applies not to the Boundary line but to the and countries lying North of the Southern Boundary line which is so elaborately de scribed and which according to him is the Only one described. In other words hear gues that the act defines the Southern Boundary As far West As the Mississippi and annexes to Quebec All the territory extend ing northward from that line As far As the limits of the Hudson s Bay territories Leav ing the Western Boundary entirely unmentioned. In order to show that this must be the meaning of the act to furnishes an Ela borate historical sketch of the Early Settle ment and condition of the country on Bot i sides of the St Lawrence arguing that from the known object in View in the passage of the act the Only reasonable construction is the one he has adopted. The treaty of Paris in 1783 settled the Boundary Between the then province of Quebec and the United Winnipeg and provision Market. Corrected daily for the free press by w. H. The proclamation of 1763, issued immediately after the Conquest defines the limits of the province of Quebec As follows bounded on the Labrador coast by the Eiver St John and from thence by a line drawn from the head of that River through the Lake St John to the South end of Lake be passim from thence the said line Cros Sig the River St Lawrence and the Lake Champlain in forty tvo degrees of North latitude passes along the Highlands which Divide the Rivers that empty themselves into the said River St from those which fall into the sea and also along the North coast of the Baic Des Chalmurs and the Gulf of St Lawrence to Cape Rosier arid from thence crossing the Mouth of the River St Lawrence by the West end of the Island of Anticosti terminates at the Afore said River St the limits of the province were greatly extended by what is known As the Quebec act which was introduced into the British parliament in 1774, and passed after considerable discussion with amendments. What is implied by the term northward As Here used can Only be Learned from another historical review. It is demonstrated that to the French belongs the credit of exploring the great Northwest that the governors of Quebec possessed and actually exercised jurisdiction Over the inhabitants and that Tho trading posts of the latter wore to be found at the time of the Conquest far up Tho Saskatchewan. Early documents and maps Are referred to As showing that new France extended As far As the Pacific Ocean and the author of the report argues that even now the Legal Boundary of the pro Vilce of Ontario cannot be shown to be any further East than the Kocky mountains. Gould in dealing in puts and Call is simply gambling and that therefore when he loses he is not to to compelled to pay his contracts. In other words Gould appears in the court through his lawyers and practically swears that his business is nothing More or less than betting and that he is entitled to the same release from any obligation it involves that he would receive if he were the keeper of a Faro Bank or a lottery or if he had made a Wager on the result of Aii election. As a general Rule the standing of the merchants of this City is of a High order but it is natural to suppose that business should be at a. Standstill at this season of the year especially when the country has experienced such a drawback As the late Grasshopper visitation. Farmers Are not in a position to spend rather to economize in every Way possible and this of course affects our Mer chants. The Supply of hour and provisions is de creasing every Day with none arriving and this in connection with the Small stocks on hand at the clone of navigation has a tendency to keep prices up. The Price of wheat is there is very Hittle offering in the Market. The weather so tar has been very mild and Farmers Are taking advantage of this As Welt As Tho Good state of the roads throughout the country to bring quantities of lire Wood into the City. No produce of any kind is arriving in any quantities. A few been by by the Sleigh Load at no Large Quantity in the country. Several parties Are using covered sleighs with stoves in them to bring potatoes to Market but this cannot be done with profit if they arc obliged to sell at less than per Bushel.
