The fact remains at any rate that the Bene fits of representative government on which As canadians we Are wont to Pride ourselves Are seriously threatened by an irresponsible body having Power to defeat the will of the people As expressed through their representatives. Herein is a Manifest anomaly which May produce very serious Conse quinces and which is Likely if brought into bold Relief by such action As the Senate has taken this session to create serious dissatisfaction with the Constitution of the Domin Ion adopted at confederation when a Nomi native upper Iio Uso was substituted for the elective legislative Council which exercised similar functions in the old parliament of Canada. It is but natural that this Retro Grade arrangement should have been viewed with grave disapproval by Many Canadian statesmen at the time while some of the More Radical wore prepared to contend that a second chamber of any kind was Alto Gether unnecessary to the successful work in of our legislative institutions. Perhaps the latter May after All not have formed a judgment so very wide of the Mark. We have always been of opinion that such a cast Iron 1 body As our present Senate is in its Constitution would sooner or later be found out of Harmony with the political Genius of the country and the advanced spirit of the age. Being composed of parti s Zans with a majority just according to the length of time a particular party has been in Power and the number of vacancies that happen to have occurred during the period of its Ascendancy the Senate is car less Likely to take a dispassionate View of Public questions that the popular House the Mem Bers of which being answerable to their constituents Are bound to take into consideration the views of the people when deciding what course on a particular division they shall pursue. The danger arising from the present Constitution of the Senate is that there Are no Legal moans of overcoming a deadlock and that at any time a conflict Between the two branches of the legislature is liable to produce a crisis similar to that which now prevails in Victoria. In the British parliament there is away of Over coming the opposition of the upper House to measures passed by the lower that has been adopted on several historical occasions and May hereafter be employed to save representative institutions from degenerating into a farce through ill judged Defiance of the popular chamber. But while her majesty s ministers can overcome the stub born opposition of the House of lords by resorting in an extreme Case to recommending the appointment of a sufficient number of life Peers to give the administration a majority in the upper House there arc no Legal Means of overcoming the obstructive of the Senate in Canada or of the legislative Council in Victoria. The number of members of each being limited by statute the balance of Power cannot be restored so As to place the upper House in Harmony with the lower chamber. Though Public opinion in Canada May be averse to tinkering the Constitution adopted at confederation until it has had a fair trial the unwarrantable partizan Atti tude assumed by the Senate during the present session has forced into prominence a ground of dissatisfaction which it would have been better to allow to rest in the abeyance a few years longer. With the australian incident before us however and the danger that some such serious crisis May some Day be brought upon the Domin Ion through party spleen and unpatriotic doggedness we feel bound to Eay that it would to Well to take timely Steps for pre venting such an awkward dilemma being perchance one of Canada s experiences in the not very far Distant future.
