That i was present at the above mentioned Sale held in the town aforesaid and taking part therein and bid upon several lots As they were offered for what is known As the Mclenaghan estate. 2. That during the Sale of lots on said estate James Mclenaghan Esquire of the said town came to me where i was in the town Hall Aud enquired from me if i wanted to buy any lot.-, to which i replied of course i do or 1 would not be Aud the said Sci Eughen then said to me if you want a lot i will give you one on the Campbell Hay and Boddy but that lid la play and Boddy estate but t useless for me to bid on the lots in the Ever take it running Brooks All in All there and Rivers. Sept. 20, 1s90. The tax Sale conspiracy. Attorney general Martin s action for libel was intended As a Challenge to Public senti ment. It was meant As a declaration on his part that he was an innocent ant honest Man whom the Public Ocie either misunderstand or misrepresenting. The suit was to Challenge this Drift. He thought his Opportunity had one for which he had been watching Tyc two he would make the most of it. The free press could not establish what it had been understood to sky the verdict would be his and he would be vindicated before the people. An offer to Appeal to the court carries with it a supposition of innocence although in this Case it waa not difficult to detect the trick which was behind it and or. Martin hoped that it would impose upon the Public much to his advantage. The incident gives renewed interest to the particulars of that Portage la Prairie tax Sale and indeed suggests the appropriateness of recalling them. We there fore m this Issue republish the affidavits that the readers of the free press May under stand in the Light of All that has transpired what a very honest gentleman this or. Martin is. They show that he was the principal of conspiracy to defraud the town or its Credi tors. Meetings of the conspirators were held in the office of Martin Curtis and in or. Martin s private room. Copies of the official Gazette containing a list of the Lota to be sold provided and opposite the lots each de tired or it was agreed each should have or. Martin marked the initials of the person to whom they were to be knocked Down the others not to bid against him. This is the plot As developed in the affidavits. Others were prevented from bidding on Var ious pleas. One was that the creditors of the town might Garnishee the amount realized and therefore it was better to let the lots go for a another was that if the Sale realized Kettle or nothing the town would be in a better portion to Compromise with its creditors. The shocking morality of these pleas will strike any one but it is in keeping with the Rast of the proceedings. Among the Purohi Seis at that tax Sale was or. That i waa present on various occasions at the Sale of land for taxes held in the town for of Portage la Prairie in the town Hall in said town and which was commenced in the month of december 1888, Aud took part therein and became purchaser thereat of various parcels. 2. During the continuance of such Sale James Mclenaghan esq., of said town came to me and remonstrated with me for bidding upon certain lands and requested me to desist from bidding thereon against persons who i am informed and do verily believe had been parties to an agreement with the said Mclenaghan not to bid at such Sale the one against the other and at the same time in formed me that the town Council of which he was then a member did not desire accumulation of any Large amount of Coney from such Sale As they the said Council feared in that event that the creditors of the said town would Garnishee the same and then and there made use of the words following to me we do not want the Money because if we get much the creditors will Garnishee it or words to that effect. 3, on the second Day of december instant m the presence of or. W. P. Smith jr., of said town i reiterated the above conversation to the raid Mclenaghan Aud charged him with being guilty of a Dir election of duty As a town councillor in the matter of such tax tale in the manner aforesaid by demonstrating with me As aforesaid and upon that occasion he did not deny that he had so acted but justified himself on the ground that the senti ments he then expressed were the opinions held by the Council of the said town at. Well my Good sister the report which Yon read is True and let me Tull you i Liat Are my reasons therefor my chief objection to Church choir sing ing is that i am a firm believer in a congregation doing the singing. To me a singing Church is always a triumphant Church. If a congregation is silent during the exercise or partially silent it is the silence of death.
