I simply proposes to protect foreign authors through a Royalty of 10 or 15 cents on each copy of their work sold without at the mos adding to the filing Price More than Tan sum. It is claimed that if the International copyright Bill pass the Senate a combination to put up prices will inevitably follow among the larger publishing houses that the Smalto concerns will be starved out and that in addition to the 10 or 15 cents to the author Thi Reading Public will be compelled to pay As much More or twice As mud a a tax to the monopolists no bet Ter illustration of the situation can be Given than to say that in the Case of the Royalty Bill it is a Tariff for Revenue Only putting the authors in the place of the nation and in the other a Tariff for Protection. In the former Case the people will be taxed a i compensation to the authors to which then a no objection while in the other they i be taxed Nob Only for the author bub for the monopolists and these we May be sure Wil gab Tho lion s share. In is the principle of Mckinley ism intended to be enforced for the Benefit of a huge Book Trust and a Power Ful lobby of publishers is at the Back of the measure to it through. There in no lobby at the Back of the other and with no thing bub its merits to defend 16 there is Little Hope of its Success. The proposed legislation a creating As much excitement in Europe As in the United states. Over there the Royalty Bill is lost sight of and the whole attention of those interested is directed to the measure which is promoted by the United states bookmakers. By the Bil it is proposed that no copyright shall be Given to a work Thau a not set up and printed in the United states. Thin should it carry would seriously injure the manufacturing Trade in England. Authors to get advantage of the United states copyright would be obliged to have their works printed in that country a circumstance that would involve double composition unless the further advantage to the United states was Given of having the editions for tha English Market also set up there. If Thia were done be Trade of the English publishing houses would be badly hit and if the alternative of double composition were adopted the extra expense would have to be shared by the buy ers and authors. Not unnaturally the Trade in England u deeply exercised Over the matter and Lettera Are pouring in on the leading Lon Don papers Suff Gosting As a measure of self defence that parliament should pass a jaw providing that no British or us item states author null obtain British copyright a Lesu copies of his work composed Anc printed in the United kingdom shall have Bra deposited Hall or the British museum before publication. Retaliatory legislation Baa never been popular in England and it in doubtful if this suggestion would a be acted upon in any Case. But should the United states copyright Bill go through a proposed there would be no other Way left of protecting the British publishers and without that Protection the business would undoubtedly suffer very severely. By simply joining the Berne convention the United states can airily and at any time Range itself by the Side of All other civilized nations in the matter of copyright. Under the pretence however that its interests and circumstances Are different owing to its isolated position in Puauea a policy of the most intense Seifrig Honeas not Only As to copyright but in respect also of All those International relations in which the Dollar is involved. There would seem to be Little doubt that the English Book Man intend to press their application hate we much ill feeling Hae been raised in the United states by the action of the Canadian authorities in forcing dispute or it parse of it into court and thus to a or Tain extent raking it out of the hands of the diplomats. Whether this was with the knowledge and Sanction of administration is not yet known. If it were the people of that country have do reason to be offended and their present Tiger u unreasonable if it were not the Ottawa authorities have been polity of n very grave discourtesy. The whole dispute Haa been in the hands o the diplomats for the Pant year or two incl latterly there has been the most Gratifying Prospect of an Early settlement. It is possible that the matter might be expedited by a reference of a certain phase of the question to the United states supreme court. In that Case it was competent for either party to Sug Geet that course and to urge its acceptance. If this were done with the knowledge of All concerned there could be nothing irregular or improper in it. Without this Mutual under Tonding however it would be merely a piece of Sharp practice wholly unworthy of a Grant nation. In is said thai the act of the Canadian minister of Justice in the approval of the Imperial authorities we can believe that if the Imperial author ties were consulted a to its expediency Thuy might have expressed the opinion that an a peal to the supreme count was unobjectionable and they would Sanction its being made. But we refuse to believe that the English gov. Ern ment consented to a proposal to steal a March on the Washington authorities in order to snatch an if there wore no advantage there could be no object in taking that course. That is not in accordance with the traditions of English diplomacy. It is to be hoped that the Canadian author Tiea will be Able to explain that the Appeal to the supremo court Baa Beon made with the full knowledge and approval of the washing ton administration. When it had become known that this step Hud been taken or. Blaino a reported to have said that he was not taken unawares by it. This May have meant either that he bad Beon advised As to the Appeal or that he had been Sharp to get on to the Little Canadian same. Id is to be hoped for every considerable reason Thiv it was the former. The dispute is an International one. Even if this Hac Beon the Firof step towards effecting a settle1 ment it would Only have been the communes1 Courtesy before invading a foreign country to go into its courts to avow the purpose before hand to those on the other Sido who were engaged in the negotiations. It waa n Hundred Timea Mere obligatory to do this after Thi whole question had been passed Over to the diplomats and was at the time in a fair Way to being settled. To take it or any phase of it out of their hands without both government being apprised of tie intention was an act o discourtesy for which there i can be no excuse it is too much like what the United state itself might be expected to do to Moke i endurable to canadians. The act assuming it to be a bit of Sharp Nesa on the part of the Ottawa authorities i Nob without something to moderate its offence we Are going into the Camp of the enemy Appeal to their own tribunals for Justice in dispute Between them and us. That is some thing in our favor although in will not excuse the manner of doing it. The Ottawa ministers pay a High compliment to the supreme court of the United states when they Appeal to it in a difference to which Thi United states nation is one of the parties it would appear however that to the people of that country there in no lol lifting virtue in this compliment and they Are showing their indignation by moving protesting resolutions in Congress this is what we would expect. They would prefer any Day to be thought Sharp rather than to be thought honorable and it a not so much the discourtesy to the National dignity that offends them As the discovery that there Are politicians in Canada a Sharp As their own. It is to be hoped however that there will be no further rivalry of this kind to far As Canada is concerned. To can much better afford to leave to our neighbors whatever advantages they May extract from importing the tricks of the Pett Fogger into their inter National relations than we can to imitate them. There Are Low better authorities on International or constitutional Law in Canada than the Hon. David Mills and in his opinion the minister of Justice has put his foot badly into it by going to the United states supreme court with any phase or Section of the Behr log sea matter. He Days Una eat it has been agreed Between the two governments that there shall be a teat Case for the Piir pose of ascertaining the rights of the United states under the Law of the nation in Behring i think it will prove a mistake of the part of the Canadian minister of Justice to seek decision from tha supreme court. The Case of poster against Neil non which will be found in Peters reports 2, and that of Phillips against Payne in vol. 02 of the supreme court reports show that in questions Auch this the court a bound to follow in the construction treaties the political department of the government and no opinion will be obtained therefore at variance with or. Elaine s Contention. It will be seen upon very blight consideration of the subject that it would never do to permit one department of the government to place itself in direct antagonism to another and specially would it be destructive to permit the views of that department which is responsible for the maintenance of the Sovereign rights of the nation to be Over Ridden by another department to which no such Rea possibility attaches. You will find the principle upon which the supreme court proceeds to fully stated in Tho two cases to which i have referred that you will see that the minister of Justice cannot get on on the lines upon which he has aet out and if the court were to entertain the Case he would Only succeed in having the Contention of the Secretary of state addressing a meeting of Hia constituent at Stayner a few Wayfe ago or. Dalton Mccarthy said that if Dominion government Prem Pidto disallow the school act he would himself move a of want of Confidence in it but if it allowed the act to stand he would remain its faithful fun lower As before. In the same speech he said that or. Chapleau had entered into an unholy Alliance with the Quebec Premier to raid the Domin on Treasury. Or. Chapleau is n member of the government.
