In is Felt that there a no occasion for excitement or alarm and in consequence the most sensational re ports that come from Ottawa scarcely cause a Ripple to disturb the usual serenity of men s Aunda. The matter has been twice before the judges of Manitoba once at the original hearing and once on Appeal. On both occasions the Validity of the legislation was upheld. These were doubtless important judgments and Are entitled to every respect Bud they were contrary to the general expectation founded on a Plain common sense Reading of the Law and Tia not surprising therefore that the question is being carried further. It will come next before the supreme court of Canada and if the judgment of the lower court be sustained the Case will probably rest there so far a b the interpretation of the Law is concerned. But should the original judgment be twined it is not unlikely that the province to the judicial committee of the Imperial privy Council. If in the last resort the Jeg inflation be held invalid the Manitoba school act Falls and the province reverts to the old order of things subject however to such amendments at any time As circumstances deem expedient. Bat should the Validity of the act be upheld will be two courses open either to accept it und live up to it unless the province to the freest exercise of its own discretion Dhall choose to repeal it or remedial Legisla Tion May be sought w provided by the Constitution. In Case it will be both pos Able and necessary to proceed according to Law order and reason. There will be no occasion and Little room for agitation or excitement or turmoil of any kind. Whatever done will be done on the straight lines of Constitution itself and in a manner to avoid any doubt or dispute. This the people Jolly had Eirand. In other words they would sell Canada to the United to Morrow if they got the Chance. Another drawback and one that tries the patience of n Highland scotch presbyterian Nore than anything else is the Power that iome has in Canada. Rome controls the solid Catholic vote and every local politician that bids highest for it gets it no matter what views he is supposed to hold on other things. All the protestant churches Are disestablished to that they Are on an Equality in the eyes of the Law but the roman Catholic Church is established in the old province of Quebec and ibis gives her a tremendous Power in the country. It is feared that there will be a civil War in Canada before the complications arising out of this state of affairs Are cleared. This is a kind of letter that is calculated to do much harm. In Manitoba North West we have Many of those crofters and other highlanders and would be glad to have several times As Many More. No better Izerial than they can be found anywhere for the building up of a great new country on these illimitable Plains of North America. But such a letter As this read far and wide throughout the Highlands will do More to frighten away those who thought of coming than would any num Ber of stones of hostile indians and wild animals. For what would these be to the sturdy fearless Highlander in comparison with the political profligacy that would corrupt and the roman Catholic supremacy thai would enslave him immediately on his arrival and to be told too that nothing can uproot these influences but civil War which his writer indeed goes so far As to intimate is imminent. A pretty Story this to circulate among those whom we would gladly invite to share their lot with us. We have corrupt it is True but t is quite a mistake to say that the Public Ife of the country is corrupt. It is also a mistake to say that the Liberal or any other arty would sell Canada to the United states. Hat is exactly the one thing which men of All parties would refuse to founder any temp tation. If the Legal controversy should result in the decision of the court of Queen s Bench being sustained the time will come for your Excel Lency to consider the petitions which have been presented by and on behalf of the roman catholics of Manitoba for red res under sub sections 2 and 3 of Section 22 of the Mani Toba act quoted m the Early part of this report and which Are analogous to Tho provi Sions made by the British North America act in relation to the other provinces. These subsections contain in effect the provisions which have been made As to All the provinces and Are obviously those under which the Constitution intended that the government of the Dominion should proceed if it should at any time become necessary that the Federal Power should be resorted to for the Protection of a protestant or roman Catholic minority against any act or decision of the legislature of Tho province or of any provincial authority affecting any right or privilege of any such minority in relation to Eastern opinions. Remarks of the Public journals on the government s Ottawa citizen John Thompson Points out that none of the petitions received have asked for the disallowance of the acts but merely that the interests of the minority be protected and this Protection can be Given by parliament. The Wisdom of the govern ment in leaving the question to be settled primarily by the courts in too evident to need comment and the question of remedial legis lation May Well be left in abeyance until the decision of the court of 6cal resort has been Given. Toronto Empire the government under the circumstances refrain from exercising the Power of disallowance but As the Manitoba act in common with the British North Amer Ica act constitutes Tho Dominion government a court of Appeal from legislation of Tho prov Ince affecting be educational rights of either catholics or protestants and As that Appeal has been made by Means of petitions it will be necessary for the government to consider the matter under these provisions of the act. They have however announced that they will not consider these petitions while the matter is pending in the courts a Duci Filion the Justice of which will be generally recognized. Hamilton Spectator the government has 6nally decided that id cannot disallow the Manitoba school act. It could properly come to no other decision. It ban Power to Dis allow provincial legislation but thin is Nob a Safaein which the Power ought to be exercised. The measure is within the competency of the legislature or it is not. If the legislature had no Power to Paes it it will not Ennd in the courts to which it is has Boen carried and interference by the Dominion government is not necessary. If it is within the Power of the legislature then the matter dealt with is one for the people of Manitoba alone to de cide upon. The people of Ontario would nut permit those of Quebec or any other province to dictate respecting their schools Aud in this respect the people of Manitoba have equal rights with those of Ontario. Montreal witness the government will not veto the Manitoba acts. They Are now before the courts and May possibly be Dis allowed. If Tho supreme court disallows them the government a saved All trouble. So Long As that is possible Why borrow trouble sir John Thompson seems to assume that the French language act will be disallowed As a matter of course. If the supreme court allows these acts As the court has done an Appeal on the education act will again lie to the governor general the same court which Haa Power no veto that act. But Tho government will not then be Able to act by itself. It will have to secure the concur rence of parliament in the passage of an act overriding the Manitoba act. Ottawa Jour dial probably not a half a dozen Ontario members of parliament would have supported a veto. No doubt the French conservatives in weighing the government s policy will make allowance for this. As they object to the Manitoba act they would probably object still More to the defeat of the government exactly As the great majority of Tho English conservatives last year objected More to Tho defeat of the government than they did to the Jesuit act. Consequently the government a not Likely to be seriously embarrassed at present by the decision to let Manitoba alone. It appeared to be the general desire of the people of the provide to protect Prairie chickens As much As possible. There was great difference of Opin Ion upon some Points but All were unanimous upon this. In the Bill the Sale of Tho game had not been entirely prohibited but he in tended to Sug Esfi to the committee when the consideration of the Bill came up that the Sale should be entirely prohibited. There had been considerable Contention As to the advisability of having the season open to Early As Thelston sept. Infrequently happened when the season was late that the Birds were not in Rood condition to Fly by the 1st of septem Ber therefore it had been thought advisable to extend the close season somewhat. Some wished it extended to the 1st of october but the 15th of september had been decided upon As a Compromise. If it were provided that there should to no Hunting until tha 1st of october there could be no Hunting with dogs. Another suggestion that had been made to him was that the Upland Plover generally leave at the of August hence in had been decided to make the open season begin on the 15th of july. In was proposed to make the open season for Deer three months instead of two months lasting from the 1st of october to the last of december. Deor could not be successfully hunted until there was Snew and there was usually not very much until the new year. Or. Roblin said that by an unfortunate oversight Prairie chickens were last year allowed to be an article of merchandise which had occasioned a Good Deal of hostile criticism. Martin introduced a Bill to authorize companies institutions or corporations incorporated out of this province to transact business therein.
