As it would appear go of the settled policy of the Federal government to waive its prerogative of disallowance excepting when necessary to Correct the obviously unconstitutional legislation of the provinces we Are strongly of the opinion that some Mote satisfactory Means might be employed to Deal with those objectionable cases. Sir John Thompson evidently believes that the dual language and school acts Are Ultra Vires of the Manitoba legislature yet he leaves them to the courts. Why not Deal with All alike if con Validity is to be the test it would to vastly More satisfactory if some simple Means were provided whereby any act that was challenged Sauld be referred to the courts. The minister of Justice a almost necessarily a sound Law yer bub his judgment does not carry the same weight or respect As would that of a Bench of judges. A year ago the Manitoba legislature pawed a measure under which the Validity of any act might easily be referred to the judges but the reference presupposes the consent of the attorney general. Under that Law the Aoh ool question might have been referred twelve months ago and by this time would probably be settled to far a the courts were concerned. But although it waa a measure introduced by the attorney general himself he stubbornly refused to consent to a reference of the school legislation. We cannot there upon depend on the local Legislatures for an easy reference of All disputed or doubtful acts As the governments that Are responsible for them cannot be made to give their con if it were possible for the Dominion parliament to provide some simple inexpensive machinery by which the Validity of a provincial act could be tested on the action of any person who conceited himself interested Ard was willing to move in 4he matter it would be More satisfactory than the present policy of disallowance.
