From a con. Ersa Tion with one of the City solicitors and a Lance at the statutes the following seems to e about the position of affairs the municipal act provided forr nral municipalities adding 10 percent to the amount of axes in arrear on the 1st of each March. In cities it was provided that a rate of of 1 per cent be added each month. It was claimed y parties objecting to these percentages that hey were really and that the local legislature had no right whatever Tompee this percentage As interest s one of the matters falling with n the exclusive legislative jurisdiction of the Dominion parliament. Recently some three cases submitting the Point in different ways were argued at Ottawa before the supreme court which holds that these percentages do not fall within the Legal meaning of the word but Are an additional tax or penalty imposed upon the tardy tax payer. While one of these cases May be taken 10 the privy Council the claim of the Proy nce that it has authority to legislate As it did s so far sustained. The cases which were taken to Ottawa were in respect to Rural municipalities in which 10 per cent is added on one certain Day of the year but from Reading the judgments of the court so far As they have come to hand it is Plain that the principle of the decision would apply to cities As Well and that the rate of j per cent per month would also be held valid and binding. Owing to the statute of 1886 being amended in 1887 and in 1888, some lawyers have objected that contusion existed As to the time when this rate could Bejohn posed and for what years. In 1886 it was left perhaps doubtful n 1887 it appeared that cities could charge not Only j per cent per month but the additional 10 per cent. As Well n amending this in 188s, objections were still taken to the language of the provincial statute. In 1889 a clause was inserted in the municipal act of that year declaring the Iii ten icon. In this act was included a declaration that Hales for taxes could not be attacked on the ground of interest being Chi urged the whole act was therefore disallowed. In 18so the clauses were separated and placed in separate acts. The reserved Joth for the pleasure of the governor general in Council. That reply was that in respect of a act providing against any attack upon tax sales As this had been the ground of dial owing the previous act it was thought to be lot Good legislation. The decision of the supreme court however renders this now o no account As it now turns out that this act was not needed. At the time it was passed with a contrary decision of the court of Queen s Bench Here it was thought necessary. As to the other act intended to Clear up doubts the City desires to have it go into race and representations have been made to shut effect. The reply in respect of it from Litawa was that there did not seem to have been any reason Why it should not have been assented to and sent to Ottawa along with other legislation in the Ordinary Way to be dealt with As All provincial legislation is n review by the Ottawa government f this act wore assented to it would make Clear what might give Rise to some litigation or trouble though several lawyers in looking up the matter contend that the legislation is Clear enough and would justify proceeding to a Sale. The City authorities however think that having waited thus Long to get a decision As to the right of the provincial legislature to authorize the addition of Wolc de Well to wait a Little longer to secure the assent to the act intended to make Clear the effect of the several amendments of four years ago.
