Daniel Sophee appeared yesterday morning before judge Walker sitting in the county judge s criminal court and had his trial on a charge of an attempt to commit a serious crime on the person of mrs. Stuart Robertson. The Crown submitted their evidence when the judge summarily disposed of the Case a discharging the prisoner. Judge Walker administered a scathing rebuke to the three magistrates of Elkhorn who committed the prisoner to gaol to stand his trial. He stated that there was no evidence to warrant such a proceeding and that the commission of peace should be taken from magistrates who would do such an injustice to any body not to speak of the expense which the Crown was put in being obliged to prosecute the Case at the conviction at the preliminary trial.
