Winnipeg Free Press (Newspaper) - September 5, 1913, Winnipeg, Manitoba Manitoba free 57 1913. Of elevator Tariff most of new charges passed without Adverse Force since monday. Farmers said to distrust present system of certificates Given at fort William. The labors of Tho Grain commission which has been sitting in Winnipeg tills week ended with the meeting held yesterday afternoon. In the morning the important. Question of Tho Tariff of Public terminal elevator charges was discussed at considerable length. Each charge was gone through most of them passed win out much Adverse comment la one or two quite a Little dissent was voiced but Tho final result of the was to make clearer Tea reason for Many of the charges of the opposition was done away with by the explanations. Tho Rale of charges referred to were those which came into Force on sept. 1, this year. Most of were approved but some interesting point3 in Reg to the shipment of Krain at the terminal elevators were brought out in the discussion. Chair Man Jurgill Drew attention to a change of wording in the rate for condemned Grain which now reads. Partridge declared that the Farmers or the impression that they were being outrageously dealt with in this matter of dockage shrinkage which seemed to be simple at the mercy of the operators of the Hospital elevators. Mckenzie of the Manitoba Grain growers endorsed this said that there was a consensus of opinion that Farmers were not receiving straight treatment on c. C. Cars. A. Jones commissioner pointed out that the difference was that at Winnipeg it was a Case of proved Sample tout at fort William it was not. Or. Gates one of the elevator men present said that the elevators would prefer to have the certificate at Winnipeg if that would do anything to allay the suspicion of the Farmers. Or. In the course of the discussion or. Magill pointed out that this Sheet was fixed by the Grain commission that the railway commission would have nothing to do with it. The charge for removing bulkheads the additional expense in handling unloading cars came under Dis Cussion j. P. Jones explained that it took twice As Long to handle a bulk head car As any other that was the reason for the charge which to the Farmer looking at it on paper might seem an excessive rate. He thought the railway companies ought to have to Supply such cars As would not require special treatment. Charge not on Farmer. Or. Masil said that the charge did not fall upon the Farmer. One of Tho elevator men said that this charge was one of those Small charges that Van ish. He knew that the exporters did not let it make any difference in their dealing with the allowed his just the same As they would with out that charge being there. A. F. Mantle Deputy minister of metric us tire for Saskatchewan said that per haps As the charge was so Small that might be True. But if it were larger to Felt sure that it would ultimately come Back upon the Farmer. To thought that somehow or other the exporter would take it out of the paid to the Farmer. Or. Marl la explained that it would be easier for the rail ways to take it out of Tho Farmer than it was for the exporter to would prefer to leave it with the exporter. Shrinkage waste too High. The Section of no Grade condemned Grain brought out some Dis Cussion. C. A. Dunning of the Saskatchewan co operative elevators thought that the allowance of 1 per cent for shrinkage waste was too High in View of the fact that the elevators had government weights in govern ment weights out. He held that the overages were excessive on the last report the allowances should to reduced the overages he knew that the terminal elevators were nor seeking overages but simply wanted to be Safe. F. A. Green. Moose jaw took in the general question of country vat or government where it was Phi wednesday. He endorsed the Sug Destinn of f. W. Or. Green asserted that there was no doubt that it was impossible to administer the car order Book As it was at present. In regard to special Binning he held that it was for the elevators to guar Antee the Quantity identity of the Grain binned. If there were a change in Quantity or identity the elevator men had broken the contract ought to be willing to pay he urged rather that the present regulations should be strictly enforced than that new ones should be made. The present regulation that the elevator men be compelled to keep the Grain separate deliver every Kernel of it in the car was Good enough if adhered to. Or. Magilll asked whether or. Green would not make any provision for Accident but or. Grean said no. The elevators should guard against that in regard to clause 176 in the Grain act defining the Powers of the Board or. Green thou Giu that machinery equipment surely referred to Scales that the Board ought to be Able to examine Scales. Or. Magil reminded or. Green it was a Mere matter of Law the Law said that the Inland Revenue people looked after that. He would not argue about a question of Law. More Power for Board. Or. A. Dunning of the Saskatchewan co operative Eleva tors said that if they had to adjust for both shortages overages they would have to Stop special Binning. They tried to overcome the possibility of human crookedness but they were not proof against the possibility of error. Judgment reserved in Taylor Case. Decision was reserved in the Case of Taylor milling co. Is. The London guarantee Accident company this being a claim for due to the Taylor milling co. From the Royal Grain company. The Royal Grain com Pany was formerly in business in Winnipeg Calgary is now in liquidation. The London guarantee Accident company is the bonding com Panny for the Royal Grain company the Bond covering commission trans actions. On the ground that the Grain was not sold on commission but bought outright the bonding company Dis claimed in this Case responsibility for the sum. In his summing up of the ease the chairman made it Clear that the Cru Cial Point is whether or not the trans action was a commission transaction of a Sale. If the former the bonding company was presumably responsible e. Anderson for the bonding com Pany had raised the Point that Accord ing to the strict terms of the Grain act a True commission transaction involved thai physical Transfer of the Grain or the Transfer of equivalent paper Bills of lading Etc.
