Winnipeg Free Press (Newspaper) - March 11, 1914, Winnipeg, Manitoba Vol. 41. Mild. Sun t&8, 6d51 at in Seta 625moon rls8, 5. O9 pan sets 4 Fuin Winnipeg,1vednesdat, mabgh11,1914. Twenty pages. No. 213. Bring out new Points bearing on noted Case Deputy chief Newton and Constable Flower testify at Hagel trial Boston was promised consideration if he would give information. Reid tried to throw blame for escape on Hagel Curt room again crowded. Lakes Grain record port Arthur and fort William Lead All ports on continent. The United states route huge growth to South in startling comparison with St. Lawrence. Under severe Cross examination by r a. Bonnar yesterday afternoon Deputy chief Newton of the Winni Peg police Force made the statement that j h. Buxton jr., had been promised consideration if he would re veal the whereabouts of Krafe Henko. Newton admitted further that Deputy Crown attorney Allen was pres ent when this immunity was promised and that the attorney general himself had also been consulted. The state ment of the Deputy chief led or. Bonnar to remark scathingly and Manitoba has come to this that a Man can buy his the Deputy chief gave this information with great hesitancy and a Senjea Tion was created in court As it was slowly brought out. Edward Anderson k.c., who is acting As Crown prosecutor in this Case remarked to or. Bonnar in the midst of the disclosure that the latter seemed to be surprised. I would not be surprised at anything was the rejoinder. Or. Anderson remarked frankly that the Crown was prepared to admit that Buxton had been Given immunity through stress of Circum stances in order to secure the apprehension of the Man who would shortly be tried at Morden for the murder of h. M. Arnold. The Deputy chief be fore this subject was dismissed said there were several others present be sides or. Allen when the promises were made to Buxton. The opening session of this import ant Case Vas pregnant with other sur Prises. A Brand new fact came out for instance when Constable Flower was placed on Uip. Stand late in the afternoon. As the Public is aware Flower is the Man who with sex con stable Reid backed into the closet at the Point of a revolver while Kraf Ehen to made his escape. Under pressure of Cross examination by or. Bonnar he admitted that on the morning of the escape just after he had left the police station Reid ran after him and said that it must have been a april who had riven Krafe Henko the Reoher. Or. Bonnar suggested to the witness that this Ell Ort to throw blame on some body else at such a time was an Evi Dence of jul it on the part of Reid. There was no answer to this from Flower. _ still another sensation was sprung during the Cross examination by or. Bonnar of provincial magistrate. A. A Bonny Castle. Or. Bonnar sought to show that the commitment of Kraf Mehenko at the preliminary hearing was irregular and that he was unlawfully confined he could not properly be termed a prisoner therefore a charge of complicity in his escape could not be brought against Percy Hagel. Mag Istrate Bonnycastle proved himself to be a cautious witness and steadfastly refused to give def univ answers to or. Zonnar As to what he had done or had not done when he presided at Tho preliminary hearing of Krafe Henko. A Battle of wits ensued in which the magistrate held out that his actions would be shown in the official records. He Promisee that these would be produced and the matter rests for the time at that. The Points at Issue were As to whether magistrate Bonnycastle had read to the prisoner Krawchenko the regular notice after the prosecution Ian concluded its Case at the preliminary hearing. Again As to whether he had Given Krafe Henko the privilege of calling witnesses and finally that As Krafe Henko was first arrested on a charge of unlawfully giving a revolver to another person the Crown had no right to re an est him on the charges of murder and robbery without first giving him his Freedom. Jury not locked up. One of the most str Dkins features of be entire session came at its close when or. Justice pm ran decided to the jury its Freedom to come Ana so As it liked Al Thoush at the same time warning them that they were not to discuss any Matt is affect. The trial with any person. This Nec Islon was arrived at after a pretty Wece of leca.1 play in which both counsel for the Crown and for the de rence assumed a conciliatory attitude toward the jury. They had been asked or. Justice Curran if they desired Fiat the Surv be locked up. And apparently both or. Bonnar and or. An is Jjon a Cpd with each other in pay to the Fine appear of continue a on Paffe four port Arthur ont., Marci 10. According to figures Compi de by Joseph Redden for the port Arthur Board of Trade the combined ports of port Arthur and fort William with ship ments of 203,328429 bushels of. Grain in the navigation year of 1913 leads All ports on the continent of America in shipments of Grain leaving the next nearest ports far behind figures for the leading ports Are As follows bustiers. Bort Arthur fort William 2030 m -,000 Buffalo 172,000,000 Duluth Superior. 115,000,000 Montreal 54,300,000 Chicago 64,000,000 these figures Are for 1913, the latest available for new York is eighty four millions in 1u12. Another fact brought into Promin ence by the same compilation of Fig Vires is the remarkable increase in the shipments from those ports in United states vessels. In four years the Amoum to of Grain taken out of port Arthur and fort. William by United states vessels has increased by approximately five Hundred per cent., while the increase in the e amount taken but in Canadian vessels during the period has been ninety per cent. This is claimed by or. Redden to indicate that the present route by the Welland and St. Lawrence is not conducive to the development of can Adian shipping in proportion to the natural growth of the Trade As would be expected from the increased production in the West. Although John Krafe Henko is eighty Miles away and in another judicial District Tois trial preliminaries Are proceeding Here just As normally and casually As if he were an inmate of one of the steel cells of the Morden jail which is a part of the court House building. Assize court for this District was opened toe re today at noon and after the grand jury had been called sworn and charged by the presiding Judsie chief Justice Mathers the court adjourned until 10 o clock tomorrow morning. This occurred at 2.30 and from that time the grand jury sat be Hind closed doors to consider the Evi Dence brought Forward by the Crown. These deliberations on which will de Pend the finding of either a True Bill or no Bill a Guin St John Krafe Henko were continued sedulously until 5.30. During these three hours the follow ing witnesses were heard Lloyd wag Ner and William Esau the two Bank clerks Wio were assisting the doomed manager h. M. Arnold on the Day of the robbery and murder and who were absent for lunch when the crime was committed Susie Bergen a Little girl who at the preliminary hearing told of seeing John j2rafcihenk.o going toward the Bank in Plum Coule before the murder or. Miller Coroner who at the preliminary hearing gave evidence touching the fatal character of the wound inflicted on the murdered Man and Johan Ndebe a Farmer who told it the preliminary bearing of having approached the Bank at mum Coulee on the Day and hour of the Ruurd or and of having seen manager Arnold with his hands up while another Man whom he did not know was in the Bank. Wiebe at tile preliminary hearing said that he did not enter or raise an alarm because he thought the upraised hands of the manager was a signal that he did not wish Wiebe to intrude sitting adjourned. When these three Crown witnesses had been heard by the grand jury the sitting was adjourned. While there is no authoritative state ment on the matter it is understood that r o finding will be returned Tomor Row morning when the court. Again opens and that a further adjournment will toe made. The grand jury will then hear the evidence of More Crown witnesses. It is further understood that the first wit Ness tomorrow will be William Dyck the Man who drove the murder car from i urn Coulee. Dycks preliminary stories Are still fresh in the Public mind. It seems that the Crown is Likely to Call at least All those witnesses who had any thing at All like a direct know ledge of the crime shortly after it had been committed or who had seen any of the grim episode connected with the tragedy. " w. H. Has Tings who is conducting the Case for the Crown seemed pleased this evening having heard from Winnipeg that three witnesses had been heard in the Hagel and Westlake trial. The proceedings throughout the convention proved to be absolutely without a parallel in the history of Manitoba politics. The town Hall was packed to the doors the crowd being so great that it was impossible for the convention managers to sift out the delegates from those who were not supposed to be properly qualified to take part. The Large majority were Ruthenia is who had either driven in during the Day or come in on special trains at 6 o clock. Many of these had been rounded up by or.
