Voting at one o clock to afternoon. More about yesterday from faze one Bennett Are reputedly not of the Best. First ballot important or. Macpherson s chances de Pend largely on the first ballot. The word hers is that if he can Nuster enough support in that first test at least two Toronto leadership candidates will drop out of the Field if they Are to do so by the Bay Street group. They Are Joseph Harris and j. Earl Lawson. And or. Massey it is said might do likewise Al though there was also a new Boom under Way for him today the suggestion being that he might be an effective setup with the strength he is expected to com Mand from younger party Dele Gates and the women. Hon. R. B. Bennett and to the inner Circle of the party who Are struggling to make Empire defence the dominating Issue of the convention. Or. One of the convention paradoxes is that while it was called primarily for the promotion of Unity within the conservative party nevertheless the keynote speech on the Issue of Imperial defence dealt a death blow to Quebec support so lethal that it is said the delegation would Bolt the convention almost in Toto should senator Arthur Meighen be chosen As Leader. And yet the convention planners must have known full Well that that would be the effect of such a speech. Three conclusions can be drawn. The the inner party interests Are so desperate in their determination to kill or. Robert Manion s chances of election that they were willing to go almost to any lengths. Is such revulsion against the kind of Quebec support available Duplessis support in the main that they would rather continue to get along without it altogether. And that goes for several of the prov inces other than Quebec too. They doubt in the Light of the clarified Liberal stand and certainly Little fault can be found with the basis the government has offered air training the Bennett Meighen speech will go Down with the general Public at All. Petitioners grounds with these preliminary observations the undersigned or. La Pointe turns to the consideration of the grounds upon which the petitioners urge disallowance of the padlock act. The grounds so urged involve denial of the authority of the legislature of Quebec to enact the statute in question and also an attack upon the Quality of the legis lation As being destructive of ele. Centary principles arid processes of British constitutional govern ment. As to the policy of the measure the undersigned is disposed to and Here to and to reaffirm the opinion his predecessors in office have repeatedly expressed and upon which their duly approved by your excellency in coun cil have proceeded that if the measure complained of be riot open to objection upon any the scores herein above indicated and assuming it to be otherwise Intra Vires of the provincial legislature your excellency in Council cannot appropriately exercise the Power of disallowance upon the footing which would require your Excel Lency in Council in opposition to fundamental principles of local autonomy to pass judgment upon the Wisdom or propriety of a Meas ure passed by the local legislature in the competent exercise of its assigned legislative Powers and for which it is responsible to its Politi Cal judges the electors of the prov Ince. The Fores of this View loses nothing on. Pc tint As regards the measure now under consideration when it is stated that the act was Nassed unanimously by All Mem Bers of both houses of. The legis lature including the representatives of the few gentlemen in Mont real who hive. Petitioned against it and that the numerous protests against the act which have been received have come almost exc Lur sively from persons in other prov inces unaffected by the Law. Constitutional Validity the remaining question concerns the constitutional Validity of the measure. Is the said act Intra Vires or Ultra Vires of the legislature of the province the petitioners question the Validity of the act broadly on two grounds first it is alleged that the act overthrows fundamental civil Liber ties in particular Freedom of speech of the press and of Public meeting and invades in these respects the legislative Field of the Dominion parliament. Secondly the petitioners contend that the padlock act by purporting to create a new though undefined crime and to provide a penalty for it invades the exclusive legislative jurisdiction of the Dominion Parlia ment in relation to criminal Law. Each of these submissions raises a constitutional question which is not free from difficulty but As the legislation in question does not fall within the criticism of any one of cases referred to above in which the propriety of the exercise of the Power of disallowance is recognized and confirmed by a Stream of precedents the under signed refrains from expressing any opinion upon the constitutional question so raised. In accordance with the practice of his predecessors in office in re Gard to questions of a similar nature the undersigned considers that the questions so raised affect ing the Validity act May be More conveniently and satisfactorily determined by the courts than by your excellency in Council upon the recommendation of the undersigned therefore he would not recommend disallowance upon the ground that the act ally invalid alternative request the alternative request of the prayer of the petition is that your excellency in Council May be pleased to refer to the supreme court of Canada for hearing and consideration pursuant to Section 55 of the supreme court act a question As to the constitutional of the padlock act the petitioners state that it la difficult under the terms of that act and of other legislation in Force in the province of Quebec for the Ordinary citizen to raise the ques Tion of the constitutionality of this act in the courts. They do Nof that it is not possible for any such per son to Challenge the Validity of the act in the courts and the under signed is riot persuaded that Means May not be found by which tha courts could be afforded an Opportunity to determine whether or not the said act is Ultra Vires of the legislature. The undersigned is accordingly not disposed to recommend a refer ence by your excellency in Council to the supreme court of Canada. Swears he gained 14 ibs.
