July 3 status Peter Mayewsky priest of of Kev. Ukrainian greek orthodox Cathedral of St. Mary the protect at Winnipeg is left unchanged result of a judgment of the supreme court of Canada made Public today. The court declined to order an injunction sought by the ukrainian orthodox Church of Canada conduct services. To restrain the priest from conduct further services As a priest of the Church and to restrain the of the Cathedral from per Bitting Validity of Church i our l the court passed no judgment on a decision by a suspending or. The Church but held the civil courts could not enforce an ecclesiastical decree and there was no property or other regal interest established which would justify it acting. The dispute goes Back to 1936 and Ltd to an order by archbishop Ohn Theodorovich of Philadelphia head of the ukrainian greek Ortho Dox Church Canada and the i United suspending the priest. He said there was no record of the congregation of the Winnipeg Cathedral Church passing such a Resolution. Consequently. He held the trustees of the Cathedral had the right to hold the Cathedral prop erty and administer temporal affairs. As to the Antinits he found it had no monetary value to justify the court in taking action however great its Sacerdotal value might be.
