He was replying to a question by j. G. Diefenbaker pc Lake Cen tre who asked if the government might suspend putting the latest freight rate increase into effect pending an Appeal by seven of the Canadian provinces. Western and maritime provinces have together appealed to the fed eral Cabinet to suspend the latest freight rate increase pending a formal Appeal by the provinces. The prime minister informed the House he had received telegrams from the premiers of the seven provinces asking immediate government suspension of the trans port Board s decision. Prerogative right he added i have been endeavouring to ascertain parliament were pointing out that Section 52 of the railway net apr geared to clearly give the Cabinet the right to intervene and rescind or vary an order of the Board of transport. In the report of the Royal com Mission on transportation the tur Geon commission it was stated that it seemed Clear that a the enunciated policy of governor in Council is not to inter Fere with the order of the Board unless it seems Manifest that the Board has proceeded upon some wrong principle or that it has been otherwise subject to error b that the practice of the governor in Council has followed the enunciated policy and c that the record Over the years discloses clearly that not Only have there been a very limited number of appeals but that in Only three cases have such appeals Beer allowed. Tile Turgeon commission room mended against Section 52 1 of the railway act being repealed amended. The provinces of Manitoba Saskatchewan Alberta new Brunswick and Nova Scotia All strenuously opposed any repeal to that Section. Their arguments which apparently impressed the Royal commission were 1 the provinces would never be satisfied to have the Board of transport commissioners the final court 2 the railways Are instruments of National policy and the Federal Cabinet should be Able to review decisions which affect the Economy of the whole country. 3 the Small number of appeals allowed by the governor in Council indicates that the governor not think the government has any right by statute to do that it May be that it can be done after an Appeal has been entered against the order. In any event the matter is being looked into but i do not think there is any prerogative right to interfere with the judgments of the Board of transport commission is. The Only Way in which that can be done is on an Appeal in the Man Ner provided by the statute passed by or. St. Laurent said. A. B. Robichaud a member from the Mari times asked the prime minister if the transport department would take the necessary Steps to defer the coming into effect of the Board s seven per cent rate hoist. Or. St. Laurent said or was fully aware of Section 52 of the railway act which provides the governor in Council May at any time in his discretion either upon petition of any party person or company interested or of his own motion and without any petition or application vary or rescind any order decision Rule or Regula Tion of the Board whether such order or decision is made inter partes or otherwise and whether such regulation is general or Liin with the Board s decisions. 4 the principles enunciated by the governor in Council Hove been judicial in character and the governor in Council has Only interfered when the Board has proceeded on some wrong principle or has otherwise been subjected to error 5 there is no evidence that any decisions have been Given other Vise than upon the merits and up on the evidence and 6 it is in the Public interest that the right of Appeal should continue As the first object of the railways is Revenue.
