Testimony showed that the boy had been playing with a length of rope which had been knotted into an eight Inch noose in the basement of the adjoining duplex at 364 Alexander Avenue on the afternoon of Jan. 25. The boy had crawled through a Small Hole in the basement to play with Joseph Contois. The Contois boy had tied a rope to a beam six feel six inches from the floor. The noose was three feet from the floor. The Accident occurred while tha Contois boy was talking through the Hole to Karen Lynn who was in the basement of the other building. Testimony showed that the rope and beam were located on the opposite Side of the base ment from the Hole in the Wall and that a Large Furnace stood directly in the path of the two Loea to ions the boy was found with his neck entangled in the noose his Knees almost touching the floor and his feet resting on a piece of Wood that was covering a cesspool almost directly under the beam.
