In a decision written by or. Justice a. M. Monnin the four Man court stands in general be Hind a judgment last March by or. Justice f. M. Bastin award ing nearly damages to Western processing and cold storage limited and its presi Dent William b. Glasby. Western originally sued Hamil ton construction company also of Portage and no longer in Busi Ness because insulating material buckled and warped after being put into the cold storage Plant in 1959. Suits were begun by Hamilton against Alsip Brick tile and lumber company limited who wholesale the insulation and against Dow. Alsip also sued Dow and Dow counter sued Alsip. Or. Justice Bastin dismissed All actions involving Alsip without costs cutting the suppliers out of the litigation. The nine carloads of Styr Span insulation supplied by Alsip. For were Cut into eight foot lengths for use in the building. The pieces began to Warp and shrink almost immediately after being installed in the building. Efforts to plug the gaps with smaller pieces were unsuccessful. Icicles and Frozen condensation formed on the building s ceiling and Walls and the flooring also became defective. The trial court was told that Styr Span was at that time a fairly new product at the Dow chemical Plant at Sarnia ont., and that the company now cures its product for a month before shipping it out.
