On the docket in provincial magistrate s court Friday were the cases of two Young women charged under a Portage la Prairie bylaw with being intoxicated in a Public place. Both said they wanted to plead guilty and get it Over magistrate Enns who has been on the Bench for Only a week granted their requests and imposed fines on both. But later in the court proceedings Winnipeg lawyer Lawrence Greenberg said a miscarriage of Justice had occurred because the women were not guilty of the charge at All. Or. Greenberg was in court to speak to another Case. Although not retained As counsel by either of the women he had taken the trouble to Check into the charges against them. Or. Greenberg asked that the women be allowed to withdraw their guilty pleas and fight the charges at a trial. Crown counsel Hersh Welch said he was in a difficult position because it was t he who should be prosecuting that was up to the Portage la Prairie City solicitor. Magistrate Enns said he had the right to strike out the convictions and the fines be cause he had t yet signed the warrants. He remanded the women to Portage la Prairie magistrate s court for trial.
