The magistrate said the Grav Chuk said the psychiatric re ports did t show any evidence of remorse although the Man realized his actions had been wrong. In passing sentence the mag Istrate referred to the fact the girl was Only 11 years of age when the relationship began and this had to be considered. He knew what he was doing was the magistrate said. His belief in witchcraft does t excuse his Ity of the offence was show ii by provisions of the criminal code which allow for whipping and a 14-year.jail sentence for first offenders on this charge. Defence counsel g. Greg Brodsky said the Man believed his wife s spells sexually excited him he would have Intercourse with his daughter a practice which began in 1968 when she was 11 years old and continued after the parents of the five children had separated. Defence counsel introduced four letters sent to the Man by his wife allegedly containing items for herbs used in witchcraft. Magistrate Darichuk said psychiatric reports showed the Man knew the illegality of the incestuous relationship. The magistrate said that in jail the Man would be Able to Benefit from counselling ser vices. His term is to be Fol Lowed by a suspended one year sentence with probationary supervision. Concern Over his wife s Witch Craft had caused the Man to consult with or. Brodsky s of fice to determine if there were ways in which his wife could be ordered to desist. Defence counsel said that after he first spoke to the Man he realized it would be Neces sary to get psychiatric reports to see if he truly believed what he said or was just saying the reports had shown the Man was convinced his wife who admits practising witchcraft had placed a hex upon him. He also believed that his Grandfather had died from the results of witchcraft. This is not a put on or. Brodsky said.
