More Power urged for ombudsman by Egon Frech free press legislative reporter the Powers of Manitoba s ombudsman should be extended to cover areas under the jurisdiction of the City of Winnipeg the Manitoba Law Reform commis Sion has recommended. The recommendation is contained in a 54-Page report on the City of Winnipeg act for warded to City Council thurs Day by acting Urban affairs minister Saul Cherniack. It follows a similar recommendation made earlier this year by ombudsman George Maltby in his annual report to the legislature. While or. Maltby said an estimated 200 complaints directed to his office in 1971 concerned municipal matters Over which he had no jurisdiction the Law Reform commission expressed concern about the abuse of municipal Powers. Both mentioned that the Nova Scotia ombudsman already has jurisdiction Over municipal matters. The commission also suggested amendments to the licensing provisions and rights of entry inspection search and seizure in the City of Winnipeg act to ensure the rights of the individual Are safeguarded. It said officials who misused Powers Given to them under the act should face a penalty and he provisions of the privacy act should be extended to municipal matters As Well. The privacy act passed last year by the Manitoba govern ment states that where an official cannot prove that there was need to exercise Powers of entry inspection search Sei Zure of compulsion damages Are due to the individual who has been wronged. Specific uniform Amend ments to the City of Winnipeg act other City Charters and the municipal act would afford Protection against oppressive con duct by municipal officials in regard to those wide Powers they can exercise beyond the scope of the privacy the commission said. Ii anyone thinks the recommendations too Radical the commission s report said it should be noted that no conscientious municipal official deliberately sets out to behave oppressively toward residents of the municipality he serves. The commission said it could t determine the extent to which municipal Powers Are abused but we think there Are indeed such abuses even though we cannot determine the the members of the commis Sion said they did t want impugn the Good Faith compe tence and helpfulness of conscientious municipal officials and other employees be elaborating on the potential for the abuse of municipal Powers. We should hesitate to be Lieve that the citizens remedies we recommend would in any Way impair the City s function ing in the Public interest be cause that would imply that the City cannot function normally without resorting to oppressive the report says. Opposition members in the Alaska pipeline approved Conti keep provincial legislature objected ast year when the City of win Peg act was being debated to he number of snooper causes contained in it. Government officials at the time Aid much of the legislation had Icen lifted verbatim from the ild City charter and that the causes were no More oppress Ive than before. The Law Reform commission Aid it would study in the future such questions As the relationship Between the police magistrates courts and Citi Zens which has generated considerable discussion in the past. In reviewing the licensing provisions in the City of win Lieg act and suggesting that the sections should be rewritten o make the City conform to the Basic Laws of natural Justice he commission also found that he City f has Power to prohibit the issuing of a licence to a woman simply because of her sex or to minors. The commission suggested he first instance is in contravention of the human rights act and the second instance is dealt with adequately in the Hild welfare act. It said the Section should be repealed. Another suggested Amend ment deals with providing reasonable notice to a property owner before the City encroaches on his land to carry out Survey work since this Type of work is usually never an emergency. It called for a cutback of the City s Powers to enter any dwelling without leave to read meter or ascertain if bylaws Are being complied with. The approach contained in the present Law the commission said is not unlike using a Sledge Hammer to drive a thumb it suggested provision for Reading meters should be included in contracts with the City so that the owner could Grant leave to the meter Reader to enter to read the meter him self or to have the City estimate the Reading. The commission suggests in general that the right to enter premises ought to be restricted and that the City be required first to request permission to enter with a warrant being available if there was an urgent need and no response. Does the City need the Power to swoop into premises on a sudden the com Mission asked. It has no jurisdiction to enact criminal Law or War Mea sures provisions. The City needs no Powers to Deal with Crimi nals malefactors or revolutionaries so Long As parliament has enacted appropriate statutory provisions and it the commission said All the City s Powers of entry search and s e i u r c including the Powers to confiscate and expropriate real property should always be subject to judicial authority. External affairs minister Mit Chell Sharp of Canada said in Vancouver after the decision was announced that approval of the Alaska route is a very very foolish Sharp said . Desired exclusive use of the pipeline and said the Mackenzie Valley line could take at least three to five years longer than the three years estimated for delivery of Oil through the Alaska line. He also referred to uncertainty and delay in arranging for financing of a trans Canada Oil pipeline and added i am convinced that it is our Best National interest to avoid All further delays and uncertainties in planning the develop ment of Alaska North slope Oil reserves by having a secure pipeline located under the total jurisdiction and for the exclusive use of the United despite rejection of the Cana Dian proposal several Oil Industry spokesmen in Canada said they thought a line would be built through the Mackenzie Valley anyway. E. C. Kurd president of trans Mountain Oil pipe line co. Of Vancouver said he is not surprised by Morton s announcement. Speaking in Toronto thursday night. Energy minister Mac Donald said he thinks Canada vill go ahead with the Macken Zie pipeline but . Will participate in it. And if the . Does agree to go along Ater it will have to do so on our the Canadian proposal has received some support Here. Congressman Les Aspin a Long time foe of the Alaska line has argued for a single trans Canada corridor for both Oil and natural Gas pipelines. Aspin said Morton s decision is a blatant example of the interests of the Oil Industry superseding the Public in a new development thurs Day a three judge court ruled that David Anderson Liberal my for Esquimalt Stanich and the Canadian wildlife federa Tion could join the three conservationist groups in their Legal Battles. A lower court judge ruled earlier that . Groups could adequately represent Canadian interests in . Courts. Anderson is chairman of the commons special committee on environmental pollution. A recent exhaustive study of the Alaska by the Interior department appeared to favor the Canadian route especially on environmental considerations. But Morton said in his five Page announcement the study showed the trans Canada route would cause greater damage to terrain and biotic habitat be cause it would be longer and traverse a greater area of per a Frost. Morton admitted the depart ment s nine volume study indicated the Alaska route involved a greater pollution risk from potential earthquakes and the Tanker traffic Down the Pacific coast. But he said significant Steps have been and will yet to be taken to protect against those this View was echoed in Van Couver by Imperial Oil pres ident twaits who said canadians should t be too alarmed about the tankers carrying the Oil along .
