If he drives carelessly allows danger Ous structural conditions to exist in Public premises or the like he is responsible for any damage or physical injuries that result from it. There Are some circumstances though in which the person who is in j u r e d has himself been negligent to some extent and his negligence has contributed to his injuries. In such cases the damages to which the injured person is entitled will be reduced proportionately to the extent of his own negligence. An example will make this Point clearer. In a Case re ported some time ago a customer in a Bank broke her ankle when she slipped on a wet rough portion of the Bank floor. The judge found that the Bank had been negligent in allowing the floor to be in that Condi top Quality name Brand furniture at discount prices 8w Low runner uni Mart is. Lou i in. . Miniver. Popoff Keith Honeyman t i o n however he also found that the woman was wearing a Flimsy badly worn pair of shoes and that they had contributed to her was Clear that she would not have been Hurt As badly if she was wearing a Good pair of shoes. The judge ruled that the woman was 25 per cent con tribute oily negligent and so he awarded her Only 75 per cent of the amount that he would have awarded if the Bank had been wholly negligent and if she had not been negligent at All. Whether a person has been contributor ily negligent and if so the extent of his contributory negligence is something that has to be decided on the particular facts of each Case. There Are no hard and fast rules. If a judge feels that both parties have been More or less equally negligent negligence will be apportioned 50-50. There is also the concept of ultimate negligence or last Clear Chance. This concept says that although a party has been negligent lie won t be held legally responsible for any resulting injuries if the other party had it within his Power to prevent the injuries in ques t i o n notwithstanding the negligence and did t do so. Again the Point is Best made by using an example. In a Case reported Many years ago a car was approaching a railway Cross ing on a Highway. The Driver saw a train approaching a a very High Speed. The Driver could easily have stopped and let the train go by if to wanted to. Instead he stepped on the Gas and tried to got past the train. He did t make it and his car collided with the train. He sued the rail Way on the basis that the train had been speeding and that the excessive Speed had caused the Accident. The trial judge agreed thai i be train had been speeding. However because the Driver of the car had had every Opportunity to avoid the Accident notwithstanding the train s Speed the judge held the Driver solely responsible. In other words even though party a has been negligent if party b has it within his Power to avoid the consequences of that negligence he is solely responsible if he fails to do so. That s the Law.
