Winnipeg free press saturday March 15, 1975 government agrees to provincial demands by Iain Hunter free press correspondent Ottawa the Federal gov eminent has agreed to Provin Cial demands to hold Back the growing Power of the Federal court and co ordinate Federal and provincial prosecution sys tems. Justice minister Otto Lang with provincial attorneys general thursday that he agreed to a continuing discus Sion on the subject. He indicated that he will be bringing in new legislation in a year or so to Amend the 1971 Federal court act although he said that the statute was being reviewed in the Light of experience with the new court before the provinces raised their objections. Lang also stated that he Wel comes discussion of the Issue in Public Point insisted on by 3.c. Attorney general Alex Macdonald supported by most of the other provinces. The Federal minister reported that there were quite fundamental differences Between Ottawa and the provinces on the constitutional aspect of fed eral versus provincial prosecutions in certain Fields. But he added that there was no disagreement Over the proposition that provincial attorneys general should supervise criminal prosecutions in Gener Al although Federal prosecutors should play a carefully defined role in some Fields. He suggested that in the areas covered by the criminal code prosecution of combines cases complicated commercial frauds and securities matters could be carried out through Federal prosecution. On the other hand Lang said he was prepared to discuss with the provinces their demand that they carry out prosecution of drug offences and other crimes which Are of different concern in different provinces. The Federal minister said it is not the intention of Ottawa that the Federal court should have extended jurisdiction which duplicates provincial court Juris diction. But he added that there is a need for a Federal court with certain jurisdictions and that he has agreed to hold further Dis Cussion with the provinces on this Issue. Macdonald the Day before the conference made a Public state ment to bring the Issue out of the closet in which he charged that the Federal government was setting up a costly dual court system. The . Minister stated that the bureaucratic expansion of the Federal court and the sys tem of Federal prosecutions for a growing number of offences was a Boondoggle and was bound to be weighted in favor of the Federal Crown.
