Winnipeg Free Press (Newspaper) - March 25, 1975, Winnipeg, Manitoba 14 Winnipeg free press tuesday March 25, 1975 Kenya s democracy is in danger by Peter Edw Akus Nairobi special owns t h e politically motivated murder of a popular and out spoken politician coupled with a spate of bomb explosions in Nairobi has put cracks in Ken y a s much vaunted political s t a b i 1 i t y and poses serious questions about the future. Both the murder of Josiah Kariuki and the bomb attacks one of which killed 27 people occurred against a background Christ and Moses Many people in so called Christian nations seem to have the belief that Christ s teachings Are contrary to those of Moses that the teachings of Moses were cruel and unyielding an Eye for an Eye and a life for a life while the teachings of Christ Are love and compassion which is generally misconstrued to mean soft sentimentality. The Laws Moses gave to the people of Israel he said he got from god and the people acknowledged that they were from god and Moses came and called for the elders of the people and Laid before their faces All these words which the lord commanded him. And All the people answered together and said that the lord hath spoken we will do sex. 19 7, at that time Israel was one nation of twelve tribes. Some time later when the people became dissatisfied with being governed by judges and wanted a King god gave them a King and fixed the line of succession in the tribe of Judah 1st Sam. 2nd Sam. 10 Jer. Later because of heavy taxation by the King on the ten tribes represented by Ephraim 1st Kings 12 the ten separated from Judah and formed a nation of their own with their own King and god said the division was of him 1st Kings 12 20, the Anglo Saxon celtic nations Are the descendants of the ten tribes. At the time of Christ s return the two sections Are to come together As one nation again with Christ As King Ezek. In exodus Leviticus and Deuteronomy we have recorded for us god s Many commands to his people through Moses. These commands were Given to develop the people not Only individually but As a nation and to prepare themas a nation to receive the promised Messiah when he should come. They were also to protect them As a nation from falling into the corruption of the nations around them. The history of both the ten tribes and of the two tribes is one of forsaking god s Law with Brief interludes from time to time when they partially repented and partially returned to it. And this course they Are still following today. God s Law is no longer recognized in our Anglo Saxon celtic lands and in Judah and hence we Are experiencing nothing but corruption trouble War poverty crime ill health and sorrow. God then was the author of the Law Given through Moses. Christ said As my father hath taught me i speak these things John for i have not spoken of myself but the father which sent me he gave me a commandment what i should say and what i should speak John god then was the author of the teachings of Christ. If the teachings of Christ contradict the teachings of Moses then god lied to one or the other but the scriptures say that god cannot lie in Hope of eternal life which god that cannot lie promised before the world began Titus god is not a Man that he should lie neither the son of Man that he should repent hath he said and shall he not do it or hath he spoken and shall he not make it numbers nor is he a god of confusion 1st Cor. The ordinances of the Law Given through Moses that is the sacrificial rites and ceremonies Paul said were abolished by Christ for the simple reason that Christ by laying Down his life daily in the service of god provided a new and better new and better Way. Having abolished in his flesh the enmity even the Law of commandments contained in ordinances Eph. Then verily the first covenant the Law had also ordinances of divine service and a worldly Sanctuary which was a figure for the time then present in which were offered both gifts and sacrifices could not make him that did the service perfect As pertaining to the conscience but Christ being come an High priest of Good things to come. Who through the eternal spirit offered himself without spot to god purge your conscience from dead works to serve the living god hebrews 9 Christ did not abolish the Law As it pertained to the Princi Ples of righteousness and Justice nor the moral Laws nor the Laws pertaining to the health and welfare of the people. Morals Are not a matter of fashion. If it was wrong to lie in Moses Day it was wrong to lie in Christ s Day and it is wrong in our Day. If it was wrong to steal in Moses Day it was wrong to steal in Christ s Day and in our Day and both Christ and Moses taught this. Christ said do not kill Luke but in saying this he said he was quoting Moses who had Given it As a command ment to Israel As part of god s Law to them exodus this is a commandment to the individual and does not in any sense have application to the nation As a nation and those therein in positions of responsibility in the discharge of the duties of governing that nation. Christ said if they hear not Moses and the prophets neither will they be persuaded though one Rose from the dead Luke for had be believed Moses be would have believed me for he wrote of me John and the apostle Paul without question a faithful Follower of Christ said hav ing therefore obtained help of god i continue unto this Day wit Nessing both to Small and great saying none other things than those which the prophets and Moses did say should come acts Christ bore testimony to the life and experiences of Noah Matt. To Jonah Matt. To Abraham Isaac and Jacob Luke to Solomon Matt. To Elijah Matt. And others As did also the apostles in their epistles. Clearly both old and new testaments comprise one Book the word of one author god and his revelation of himself to Man. Much of this is dire Tecl against 83-year-old president Jomo Kenyatta and Jie Small group of kikuyu who effectively control the country. The discontent and unrest is due basically to two things both of which offer plausible explanations for the murder and the bombings. First there s a growing feeling among Many sections of the Popula Ion that the fruits of Kenya s Independence and Prosperity Are going to too few people. Secondly and perhaps most importantly is the fact that he Kenyatta Era is drawing to a close and a lot of people Are beginning to place their bets in the future. There was certainly a lot of Money on Kariuki a former assistant minister whose Charisma was probably Only matched by that of president Kenyatta and the fact that he is been removed almost cer mainly Means that the betting is begun to hot up. Kariuki was a kikuyu Kenya s dominant tribe but he Vas a Northern kikuyu and the northerners Don t exactly see Eye to Eye with the Southern or a Iamb clique to whom pres Dent Kenyatta and other key government ministers owe heir allegiance. There is Little doubt that Kariuki was after president Kenyatta the most popular politician in Kenya with sup Jort going across tribal lines. Vitany even maintained that in a straight contest with the president he would pick up the majority of votes. Because of this he was undoubtedly seen As a threat to Post Kenyatta Kiambi Aspira Jons and the Kiambi King makers undoubtedly had much of gain from Kariuki s disappearance. Whether president Kenyatta himself would have been involved in any Kiambi plot to kill Kariuki is difficult to Tell. Even the parliament select committee which has just been appointed to investigate the murder is unlikely to make such a bold accusation. For a Start it has been proved fairly conclusively Thal previous political assassinations have been carried out after bathing ceremonies in which those involved swear never to reveal their accomplices or principals. Secondly the president could prologue parliament if he found the investigation a Little uncomfortable. This would Stop the committee s inquiry and would also prevent it from re leasing information on the re sults of the investigation so far. But even if they Are unable to Point their fingers right to the top the findings of the parliamentary select committee will almost certainly prove very embarrassing to a number of government figures. Kariuki was last seen alive on March 2 at a Nairobi hotel and according to Well substantiated reports left in the com Pany of two members of Kenya s special police Force the Gnu. His Bullet riddled body was found the following Day in a Forest near Nairobi and taken to the City mortuary but his disappearance was t made Public for another three Days when the matter was raised in parliament. The police and the govern ment spokesman in parliament vice president Daniel Arap Moi denied knowledge of Kariuki s whereabouts for an other four Days until the Tody was identified at the mortuary by one of the dead Man s three wives. Nobody has offered a convincing explanation for any of these strange events. The police have said that the body was too decomposed for them to make a positive Idun Tifilca lion but this seems unlikely since it was taken to the mortuary Only one Day after the murder. Furthermore members of parliament Al Lowed into the mortuary said they had no trouble in identify ing Kariuki. The committee is very Cei .0 come up with something positive since As one member of parliament put it democracy is in danger in Kenya and unless those responsible for the murder Are found other parliamentarians could become victims of assassins. Kariuki is not the first Poten Ial successor to Kenyatta to be killed. In 19g9 the vice president Tom Mboya was shot dead in a Nairobi Street and towards the end of 1973 the prominent coastal Politi Cian Ronald Ngala met his death in a Road Accident that has t been satisfactorily explained. And just after in dependence the leftist Back Encher Pio Pinto was Mur Leral in mysterious Circum stances. The fear among the More outspoken politicians in Ken t s de Facto one party system s that assassination could be come the Standard method of silencing outspokenness and jetting rid of Post Kenyatta residential candidates who Don t meet with the kikuyu Nafia s approval. It seems unlikely at this stage that the bomb explosions Are in any Way connected with Kariuki s death but they do fit rather neatly into the present political situation since responsibility for at least one of the explosions was claimed by an organization calling itself the Masi Kini poor people s liberation movement. If there is in fact such an organization it could Well have 3een spawned by Kenya s poor and University students who eel there is an increasing con meet a proud Canadian. There is a massive unemployment problem among the unskilled in Nairobi housing is in very Short Supply and the poor have been hard hit by inflation which is running at about 16 per cent a year. One tanzanian newspaper recently described Kenya As a Man eat Man society and Kariuki once said that under the present government Kenya was in danger of creating 10 millionaires and 10 million beg Gars. The students at Nairobi University have been critics of present government policy for a Long time and there have been a number of bitter confrontations Between students and the authorities in recent years. The poor people both the employed and the unemployed have become increasingly Dis enchanted with policies which seem designed More to enrich an already wealthy elite than to help the Broad mass of the people the Wanandhi As they Are known in swahili. It is highly Likely then that one of the police theories for the bombings that of a col Lusion Between some students and a Small group of unemployed could be right. Further bombings Are cer Tain to Lead to More authoritarian controls. Further Politi Cal murders Are certain to Lead to reprisals and perhaps also greater authoritarianism. To Gether they could produce Kenya s own answer to Gen. Idi Amin. There also Are 350 tax investigators who specialize in checking on suspected tax evaders. Tax evasion is deliberate non filing with intent to deceive. Last year the Revenue department investigated 836 suspected cases and eventually obtained court fines of against convicted offenders. But the tax Man knows that not All non filers Are out to deceive him deliberately and there is a procedure for these people to make a voluntary disclosure. It also applies to those who have made a false return. Over the years thousands of cases have turned up of people who have never filed income tax returns usually because they did not believe they had taxable income. Sometimes they Are self employed in other cases their employer failed to make the required deductions at source. If they simply walk into the nearest of the 28 tax offices across the country and declare their non filing status Little May happen. The Revenue department promises if a taxpayer makes a reasonably com plete voluntary disclosure re lated to those returns he is permitted to Settle his liability by paying the tax and in Erest due without penalty or provided there is no Evi Dence of fraud the Revenue department freq Eiguy asses ses taxes Only for the four previous years. Two Points must be made however. It is too late to choose the lenient voluntary disclosure route if you Are Al ready being investigated. And secondly if the tax Man detects past fraud or misrepresentation any time after Dis closure a stiff penalty May be added on top of the inter est due. If there is evidence of fraud a penalty As High As twice the amount of past taxes owed May be charged upon summary conviction. For Gross As failing to report earned in vestment income for which you received t-5 penalty May be 25 per cent. And the taxes May be charged for As far Back As 10 years depending upon circumstances such As the Avail ability of records. A taxpayer who feels his Case May be a bit shaky under the critical Eye of a tax investigator even after Mak ing a voluntary disclosure should consider seeing a Law yer beforehand. The Revenue department May not advise this but a lawyer can some times soften the blow. Often a lawyer can arrange an unwritten agree ment with the tax people so that taxes will not be levied further Back than four years. Then the taxpayer can go to the tax office and identify himself. Again this route will work Only if the taxpayer is not already under scrutiny. An employer who has not deducted from his employees wages for income tax or other benefits like unemployment insurance and Canada pen Sion plan May be in serious difficulty. He will have to pay Back taxes if discovered plus a penalty charge of 10 per cent and the usual six per cent an Nual interest. In addition he must pay 100 per cent of cup benefits and the employee s share of past unemployment benefits.
