Teacher wins Case against Board the Transcona Springfield school division has been or dered to pay nearly to a teacher a judge Hap ruled was discharged contrary to the provisions of a collective agreement. The teacher Harold Syrett who almost four years ago received a letter from the division terminating his employment will be receiving the remainder of the salary he would have earned during the 1972-73 school year. Or. Justice w. Scott Wright of the Manitoba court of Queen s Bench said in his written judgment that the division could have properly discharged or. Syrett june 30 without violating a clause in a then existing agreement Between the division and the Manitoba teachers society. The agreement contained a clause on tenure a which said that employment could be terminated during the school year Only by a joint commit tee of the school Board and executive committee of the teachers association. The division took the stand Community police Force eyed alcoholics one of its targets the Manitoba department of corrections is considering establishment of a Community constabulary to Deal with social problems in the downtown area of Winnipeg. Corrections minister j. R. Bud Boyce told the Legisla Ture thursday it should t be called a special police Force rather a Community constabulary he was asked about it by Lloyd a worthy a fort Rouge Dur ing the question period. The minister said one of the problems it would Deal with would be alcoholism in the Core area. He said the plan May or May not evolve but it is under consideration. In court that the clause applied Only to those teachers who with two years of ser vice have already the right to binding arbitration upon termination of employment under the provi Sions of the Public schools act. The division argued that if the clause in the agreement Between it and the teachers association did t express this interpretation then there was a mistake in drafts Manship and asked the court that it be rectified. Or. Justice Wright rejected both arguments. In my opinion the Lan Guage is patently Clear that All teachers Are entitled to the however the judge said the evidence was a Long Way from the Stan Dard of proof required for an order of rectification. He called an addition to the agreement made in 1973, aimed at imposing the tenure special beat conditions set out m the Public schools act an illogical since these teachers have recourse to the Public schools act one wonders what purpose the amendment serves or.
