The Board decision noted that both the Csc and Nabet had asked for special consideration because the old contract had run for four years from july 1971 until 1975. The Board said it consid ered the fact that the anti inflation act regulations do not make adequate allow ances for such Long term agreements. While Nabet members pay rates Rose by an average 33.8-1 per cent Dur ing the four years of their previous contract the Cost of living had gone up by 39.11 per cent. Board members also look into account rates of pay for the Csc technicians and for broadcast employees in other organizations but said it did not allow immediate Restora Tion of pay relationships with similar groups. The Nabet employees currently earn Between and annually. The Board refused to alter its decision in three other cases in which unions had re Quested a review. Russ Paulley said in an interview that although the new proposal stopped Short of a compulsory first con tract it did carry a Mes s a g e to the code could t be changed for a year without the consent of the Union group or. Paulley said. Under other p r o p o s e d amendments All unfair labor practices defined by Legisla Tion would be dealt with exclusively by the labor Board. Under present legislation they May be dealt with i ther by the courts or by the Board depending on the wishes of Bolh parties. No Appeal procedure is provided in the proposed changes bul an order of the Hoard could he reviewed by the courts on the ground that the Board had exceeded its jurisdiction or Viola tort Natu ral Justice. In cases where Board Deci Sions including those for certification of a Union Are to be taken to court for review the amendments require thai inc application he made to the court within 30 Days of the Board order. Or. Paulley indicated this change was designed to pre vent lengthy delays by employers in taking labor Board decisions to court for review. The Only exception to the 30-Day limit would be if an order or decision of Hie Board was obtained . The amendments would also give the labor Hoard Power to award comp Onsa Tion of up to shoo to n person round by the Hoard to be a victim of unfair labor practice even though income had t been lost. The Amend ments Stop Short of giving the Board authority to impose Fine in cases of unfair labor Pra ticks. Or. Paulley said he by the changes the employer lives matters affecting labor should be resolved by those primarily concerned unions employers and the labor Board. The minister said the proposal to raise to 50 per cent the required level of employee approval for application for certification or de certification of a Union was fairer than the present 35 per cent. One amendment is aimed at preventing a change of Union representing an employee group during the nor Mal period of negotiation for a contract. It provides that modifies in the Case of a one year agreement application for desertification or certification of a new Union could occur Only during these Venth eighth or ninth month of the agreement. In the Case of an 18-month agreement a change of Union or status of a Union could occur Only Dur ing the 13th. 14th or 13 month. Or. Paulley indicated some difficulties had been experienced because of the Lack in existing legislation of a requirement that parties in a labor dispute meet with conciliation officers appointed by his department. An amendment would make such meetings compulsory. The Only major change in definitions of unfair labor practices is the one prevent ing an employer from indicating his objections to unions or his preference of one Union Over another. Or.
