Winnipeg Free Press (Newspaper) - May 29, 1976, Winnipeg, Manitoba Manitoba needs Council set for showdown on Triec Bill of rights report says Manitoba s Law r e f o r m commission has issued a Nix Page report calling for the establishment of a Manitoba Bill of rights. Such a document it argues would provide added Legal Protection of such exist ing rights As Freedom of opinion conscience religion expression communication Assembly and association. The commission launched an inquiry to examine the desirability of a Bill of rights under 1" o r m e r attorney general Al Mackling in february 1973. The commission report says such a document would promote Public consciousness of civil liberties and would constitute an authoritative declaration As to what society agrees upon As being of fundamental the report rejects the argument that a Bill of rights tends to be too rigid and cites the United states Bill of rights As an example of one which is flexible while clarifying individual rights. For example the Bill of rights led the Way to achieving desegregation despite tin opposition of various state a Gisla Tures and the reluctance of Congress. The commission states that it May be just As useful to have checks on parliamentary sovereignty us it was to have checks on monarchical Power 300 years ago. Just As parliamentary sovereignty was a curb us the absolute monarchy of Lin Early 17th Century so a writ ten Bill of rights could be an expression of the curb on the Cabinet dominated Purlin ment by the sovereignty of the people expressed through the Rule of Law embodied in a Bill of the report contends that a Bill of rights serves As a Means for enshrining inc Basic values of a society and As such becomes a useful educational tool particularly for Young people. 1 n addition individuals who feel their rights have been violated would with the existence of a Bill of rights have recourse to the court of Queen s Bench. It would be empowered in a proper Case to order compensation. Winnipeg s civic executive Puli e y committee recommended Friday that Public lenders be called for an million 983-ear underground garage at Portage and main with the Hope that Triec corporation will build an million development Over it. The recommendation will o to Council wednesday night and is sure to bring about much debate about the size of the garage and whether it should be built at All. Construction of the garage by the City is a vital link be tween the development of Triec s project and of an underground concourse that would be the four Corners of the intersection. Triec chairman of the Board James Soden has made it Clear to the City that without the City building the 983-car garage his company would t participate in the underground concourse. Although t h e committee voted unanimously to recommend the three level parking Structure at the Southwest Corner of Portage and main three of its members expressed doubts about a nether the City needs or wants that Large a garage. C o u n c i 11 o r Bill Norrie Rouge said there might be some prob lems Selling this to Council and there might be some traffic problems but it seems we have no alternative to proceed if not we could become involved in an endless series of court mat ters and the project would not go Forward for some considerable time other councillors including Norm Stapon Kildonan t had reservations about agreeing to the garage but said they could t see any alternative.
