Dewar has ruled St Boniface French language activist George Forest does not have the right in Challenge the constitutionality of Manitoba s official Lan Guage act in court of Queen s Bench. In a decision made Public wednesday the judge said Forest had argued his Case in a lower court and had no standing to Challenge the 1890 legislation which English the Only official language in provincial courts and tin legislature. Forest an insurance Salesman won a favourable judgment in 1976 when a county court judge declared the act invalid and allowed court documents to be filed in French. But when Forest followed up and began submitting statements in French higher courts rejected them which led him the Issue before judge Dewar. The judge said if he were find the act valid it mini Embarrass the county court judge. He suggested Forest proceed with his Appeal of an English Only parking ticket the original spark leading to Forest s protest Back in county court. Judge Dewar said for him to Render judgment in the Case. Said in an interview wednesday he will take the ruling to the court of Appeal. Mcgill told the legislature he re leased the Bill now to seek Public opinion on it a View to preparing legislation for next year s ses Sion of the legislature. While no inter session Al committee is to be named the minister said he hoped submissions offering suggestions and criticisms of the draft Bill would be made to his office before november. The proposed new legislation contains seven major changes from the personal investigations act passed in 1971. These include the following pro visions personal reporting agencies will have to be registered. Mcgill said this would enable his depart ment s Consumers Bureau to identify the agencies so it would be Able to advise citizens of the names and locations in Manitoba that maintain personal files on citizens. A business obtaining and using a personal report on an applicant must inform the applicant the manner in which he handles his obligations in the transaction May be reported to others.
