Up police officers might be driven to brutality on occasion be cause they Are frustrated by Overly Liberal Laws which protect known criminals says Ste Ven Harper chairman of the Waterloo regional police com Mission. Harper said Laws giving groups such As the Hench men motorcycle club the same liberties As those Given to per sons he called decent Law Abid ing citizens Are wrong. The Laws should be changed to reflect reality he said. Harper said in an interview monday that such Liberal Laws might have been responsible for the actions of Waterloo regional police officers which subsequently became the subject of a lengthy inquiry by the Ontario police commission. The inquiry into allegations of police brutality against the Force was prompted by com plaints from members of the henchmen club and other Citi Zens. Syd Brown was fired ear Lier this month As chief of the regional Force and four officers were demoted by the Waterloo regional police com Mission after the provincial body released a report that was highly critical of the Force s operations. Harper a lawyer said the abuses might rot have occurred if policemen had not become frustrated by Laws that treat habitual offenders As first time offenders. Canada has one of the most Liberal criminal codes in the world he said. In saudi Arabia if you plead guilty to an offence with a death penalty you Are behead he said. If you plead not guilty and Are convicted you Are stoned to death. Somewhere Between their system and ours lies Harper questioned specifically the right of habitual offend ers to remain silent and the right to be found innocent unless proven guilty beyond a reasonable doubt. He argued that such offend ers should be tried under a procedure which would require the Crown to prove guilt Only beyond a reasonable Prepon Derance of under current Laws police officers face the frustration of knowing who the criminal is and not being Able to prove the Case beyond a reasonable doubt. That frustration some times surfaces As police brutal Ity Harper said. He said however he does not condone police brutality even when it is directed at habitual offenders. He also said that under the current Law the regional police commission acted properly in firing Brown and disciplining some police officers. On the right to remain silent he said there comes a Point where most members of society feel that these continual Law Breakers ought to be required to explain their action and if they Don to society should be Able to Deal with them Accord Harper said that Between 80 and 90 per cent of crimes committed in the Region Are perpetrated by a hard Core of about criminals. And there s an astounding number of offences committed by persons on he said. I m not sure the bail Reform act should apply equally to a habitual offender As to everyone referring to the police com Mission inquiry he said this affair has been characterized As Brown against the Hench men with the henchmen the Winner and Brown the loser. The losers Are All of us. There Are no the Public loses because its police Force is disrupted and it pays the Bill for the inquiry he said. Pm admits present monitoring insufficient Ottawa up prime minister Trudeau pledged tuesday to step up govern ment monitoring of for eign owned firms operating in Canada to make certain they adhere to a set of 1975 guides Laid Down to protect the country s interests. Trudeau acknowledged in up air reduces time increases Winnipeg up i up air announced tuesday a new Holiday fare Structure Between Canada and Amsterdam providing longer stays in Europe and reduced fares for Early bookings. Passengers who Book 60 Days in Advance from Winnipeg Toronto Calgary Edmonton and Vancou ver will save on a round trip. Maximum stays in Europe will be tripled to 180 Days from 60 with minimums remaining at seven Days. The new charter class fares subject to govern ment approval Are scheduled to go into effect May i. Also announced were increases of about five per cent on first class and Normal Economy class rates effective april 1. Under an existing agreement Between up air and Kim Royal dutch airlines passengers from Toron to and Montreal can go on one Carrier and return on another. A new 20-per-Cnnt discount for children Between the Ages of two and 11 also was announced. Children previously paid the regular charter class rate. Young people Between the Ages of 12 to 25 also have been offered savings of about 17 per cent effective april i although there Are certain restrictions. I he rates apply on to travel originating in Canada from oct. 1 to May 31. The now tariffs also provide More Liberal conditions for excursions. S High school students today Are doing better in most of their subjects than their 1950s or 60s counterparts a Survey recently released by the Canadian education association says. The Survey says a majority of the 115 Canadian superintendents polled in 1977 thought senior High school students Are better in biological sciences physical sciences and second languages than students of 10 and 20 years ago. Compared with 1960s students 71 per cent of the superintendents said today s students have improved in the biological sciences. Another 55 56 per cent saw an improvement in physical science and second languages. Less than a third of the respondents 22 29 per cent did t report a change in performance. But today s students Are weaker in both the physical and biological sciences according to the superintendents 22 per cent for physical and 7 per cent for the educators reported similar comparisons Between today and the 1950s in these areas. Mathematics and social studies students perform similarly 10 1960s students according to the superintendents. While about half the educators saw an improve ment in these two areas the other half were split Between not seeing any change and seeing a decline in these subjects. Similar comparisons were drawn for today s Stu dents and those of the 1950s. At the same time about half the superintendents said literature and language students weren t performing As Well today As students in the 1960s. Another 18 per cent said they did t see any change in this area and 34 per cent Felt students had improved. The commons there has not been sufficient monitoring of some foreign controlled firms in accordance with the guides set out by alas Tair Gillespie then minis Ter of Industry Trade and Commerce. Gillespie now Energy minister was quoted As saying in an interview this week the guides have been largely ignored and that there has been Little Effort made to inform International corporations of the rules. He said later there were inaccuracies in the published report of the inter View but he declined to be specific. He said the Media must publicize the guides. He said the guides Deal with such items As ensuring senior and Middle manage ment jobs for canadians and developing policies for Canadian investors to participate in the equity of a company. Trudeau was responding to new Democrat Leader de Broadbent who asked Why the government had so completely failed in the stated course of action it established almost four years the prime minister said he has not seen any recent report on How the guides Are being applied. If some firms say they have not been following the guidelines and some firms say they have we shall take note of it and make sure that More and More do follow the tru Deau said. The prime minister also said the foreign invest ment review Agency set up to screen new takeovers of businesses in Canada has beefed up its capacity to Monitor the application of such guides. Broadbent charged that the Liberal government s failure to Force compliance with the rules has resulted in fewer jobs for canadians. Trudeau denied the charge saying the Mere fact the guides existed must have produced some results. If they have not been applied with enough Force and strength i will ask the minister of Industry Jack Horner to report on this and to make sure that the guidelines Are adhered he said. Gillespie said in the interview that he had a Tough fight in Cabinet to get the guides approved but that it had All gone for nought. The investment review Agency has no Legal Sanc eign owned firms who May not be acting As Good corporate citizens. The Agency screens direct investment proposals to determine whether or not those investments Are Likely to be of significant Benefit to the Agency then makes a recommendation to the Indus try minister. The Gillespie guides set out in a publication entitled a businessman s guide to the foreign investment review act request for eign controlled corporations to pursue policies that utilize Canadian technology resources and Man pow however the Booklet makes Clear that the guides Are Only principles and Are not issued under the author Ity of the foreign invest ment review act.
