Winnipeg Free Press (Newspaper) - July 10, 1980, Winnipeg, Manitoba Ruling leaves Crown without court by Kevin Prokosh the Crown cant seem to find a court to try a male accused of impaired driving on his 18th judge Charles Rubin yesterday ruled the accused was a juvenile and could not be tried in provincial judges in a similar Case earlier this judge Brian Giesbrecht ruled a person accused of committing an offence on his 18th birthday was an adult and could not be charged in juvenile yesterdays decision surprised senior Crown counsel Wayne mesh so we have two conflicting from the provincial judges court one from the juvenile division and one of font the adult he said in an inter View following the one of these two decisions is obviously it appears that at the moment we dont have a court to charge this he according to the criminal a person Doest become 18 until mid night on the Day of his 18th but the interpretations which is used to determine who Falls under the provisions of the juvenile delinquents states a person is 18 at the Start of the Day of his 18th judge Rubin based his decision on the criminal code to find otherwise in my View would be to compound an Absurdity since the age of majority May vary from prov Ince to and be inconsistent and he told the but in the rung leaves a person who commits an offence on his 18th birthday above our department Hai always taken the position we Areni Ovett concerned whether its the Cri Mitja code or the juvenile delinquents Ait that just As Long As one of Mem Moshkowsky although the Situa Tibet appears to make people immune the Law on their 18th Moshkowsky said this int the lets face they Are not going to get away with we they Are going to be prosecuted and convicted in one Coon or the but at the moment i cant Tell you which Moshkowsky intends to Send judge Rubins decision to a department responsible for appeals and ask it to consider appealing the the Crown has 30 Days to file an i dont know what any appellate court will eventually Rule on which court is the proper forum to hear the but i can guarantee Rule one of them Moshkowsky there not going to Rule that this person is immune from the Law for a 24hour period because that would be absolutely Canadas own Mack Sennett was King of Clear tonight 21 showers tomorrow 3 2 Winnipeg free press july 1980 ids no Ier Fth of Sun rises sets Moon
