Chretien was commenting on the government s decision to Appeal the unanimous Al Berta court ruling that Ottawa has no right to impose a Federal excise tax on natural Gas exported to the United states from Wells owned by the provincial government. The five Man court agreed last month with the Alberta government that a natural resource constitutes Provin Cial property within the meaning of Section 125 of the British North America act. Alberta challenged the tax As an invasion of provincial jurisdiction after the Federal government imposed in its oct. 28 budget an excise tax of 30 cents a thousand cubic feet on All natural Gas sales whether destined for foreign or Domestic markets. In a 33-Page report the Alberta court said Gas exported in such a situation would not be subject to fed eral tax and would be outside parliament s jurisdiction. Alberta Energy minister Merv Leitch cautioned at the time that wide conclusions should not be drawn from the Legal action against 9 Oil giants ruled out decision. He noted it was narrowly based on Crown ownership of three Wells drilled near the Montana Border last fall in anticipation of a court Challenge against the Export tax on Gas.
