The constitutional amending formula unveiled by eight premiers thursday is a better Way than prime minister Trudeau s Constitution Resolution. It is a better Way because it has been arrived at through consensus not confrontation. It is a better Way because it is supported by eight provinces including All four in Western Canada three of four in Atlantic Canada and by Quebec. It could still gain the support of Ontario and new Brunswick. The provincial Accord is better be cause it is both flexible and protective of provincial rights. Constitutional change under the provincial proposal would require approval of the Federal government and a majority of the legislators in seven of the 10 provinces representing 50 per cent of Canada s population. The Trudeau Resolution by giving a veto to provinces with More than 25 per cent of Canada s population on Tario and gives the other provinces second or even third class citizenship. The provincial proposal is better be cause it would remove the veto thai the non elected Senate would gain under the Federal government s Reso Lution. Instead the Senate would Only be Able to delay constitutional Amend ments for six months. Referendum omitted the provincial proposition is better because it omits the awkward referendum procedure by which the Federal government could do an end on the provinces above All the provincial proposal does not Force the government of great Britain to Amend the Canadian Constitution in a Way that is opposed by two thirds of canadians and by ight of the 10 provinces. In Blunt terms the Trudeau pro Osal is divisive and would eventually provide a basis for further Chal Enges to Canadian Unity. The pro Viii Ial proposal on the other hand tends to recognize the realities of Canada. One of those realities is that Minori ties in Quebec or in Atlantic prov inces or in Western Canada will not be subject to centralism without some safeguards. In Canada the regional safeguard does not come from the Senate nor in the Case of Low population regions can it come from the House of commons. Therefore it must be enshrined in the Constitution and be unassailable. Point made the Point was made thursday that in the sovereignty association referendum last year Federal liberals told quebecois there would be a reborn confederation. The implication was that there would be a constitutional guarantee of greater provincial Powers. In fact As Premier Rene Levesque put it or. Trudeau took off in the opposite it is significant that on april 13 the people of Quebec overwhelmingly voted for Levesque s party to govern them and defend their rights. Justice minister Jean Chretien rejected the provincial proposal thurs Day even before the premiers held a press conference. He again echoed Trudeau s position that a charter of rights must form part of the Resolution sent to Britain. Both Chretien and Trudeau believe the provincial proposal will Lead to a Checkerboard Canada with differ ent rights applicable in different parts of Canada due to opting out provi Sions. Bui the Federal government has negotiated a Canada pension plan that Quebec opted out of and instead de Vised its own version the Federal government has negotiated different ways of administering family allow ances to conform with provincial wishes and special arrangements have been made for Federal contributions to Post secondary education. The most blatant example however is time Trudeau willingly agreed that minority language rights do not apply in Ontario As they do in Manitoba and Quebec. Eight premiers unveil their two Points were emphasized by the premiers thursday. One there is nothing in their Accord to prevent Trudeau from advancing his charter of rights. Second the opting out provision of the provinces proposal would apply Only when a province believes its rights Are threatened and Only on future constitutional changes not on anything in the Constitution As it now stands. Unless Trudeau and Chretien intend to make future attacks on provincial Powers it is difficult to see How they alternatives to prime minister can reasonably refuse to accept the provincial proposition. Saskatchewan Premier Allan Bla Keney expressed optimism that the Federal government May be willing to give a Little ground. Ottawa had relented previously in extending the time allocated to the joint committee on the Constitution in extending the time for debate in the commons and in waiting for the supreme court s ruling before pressing Britain to pass the Patria Tion pack age. Certainly Trudeau s arguments for plunging ahead Are weakening fast. He has maintained since last sep tember that unilateral action was required because the provinces cannot Trudeau s Patria Tion package at agree among themselves. That has now been disprove. He has been concerned about meet ing his july 1 deadline claiming that if Patria Tion was not achieved by that time momentum would be lost and it would never be accomplished. Opportunity the provincial proposal actually provides an Opportunity to Speed up the whole Issue. Patria Tion with an amending formula has always been Ontario s position so the premiers see no difficulty in Premier Davis agreeing to their Accord. Similarly it is believed that new Brunswick Premier Richard Hatfield could be persuaded to agree.
