Indians Metis inuit oppose rights charter in Constitution continued from Page 1 their rights Daniels said. Justice min ister Jean Chretien has already rejected the proposal. The proposed charter of human rights states that anyone can go to court if convinced his constitutional rights Are being violated. But Daniels said it is not Clear whether that applies to the Section containing aboriginal rights. And the aboriginal rights Section which recognizes and affirms yet to be defined rights does not clearly state that these Constitution rights clauses take priority Over Federal and Provin Cial rights legislation As they do in the rest of the charter Daniels said. Daniels suggested 53 changes in the charter of rights but the major ones include having aboriginal rights guaranteed instead of Daniels said he wants an enforce ment clause because the history of broken deals by non indians in Canada is extensive. Daniels said he earlier agreed to support the Federal proposal but now thinks it is too weak. But with three Days to go before the end of constitutional debate he said he is not expect ing much. After the debate Only a supreme court judgment on Manitoba s Appeal can Stop the proposal going to London. Daniels said that if the rights pack age is not improved the Metis group if it can raise the Money will Send representatives to London to oppose the package there. Daniels described a Stark contrast Between the High ideals set Forth by Trudeau on the rights of Man and his treatment of the indians and said this contrast was based on two factors. We live in a racist Daniels said. Native people Are being offered selective rights. The second Rea son he said is that the land grab is going on right cites James Bay pact he cited As examples violations of the Manitoba act by Federal and provincial governments and Federal attempts to renege on the James Bay agreement once heralded As a far sighted and generous settlement. Now officials Are saying Ottawa cannot afford to live up to terms hammered out with Quebec indians. Manitoba act violations Are being pressed before Manitoba court of Queen s Bench but Daniels said a decision is unlikely before september Long alter the constitutional proposal is dealt with. The National Indian brotherhood rejected the constitutional package last week after various regional chiefs including Lyle Long claws of the four nations confederacy in Manitoba objected to the National organization s endorsement of the charter and the Deal worked out Between the liberals and the nip. The Nib now wants a requirement for Indian consent and an Indian referendum under the amending formula before any constitutional changes could affect indians. Meanwhile the inuit will reluctantly stick by the Federal government Al though they also want to have a say in future amendments to the Constitution. Well still stand by it but we re not satisfied with the amending said Eric Kagoona co chairman of the inuit Tapir sat committee on National issues. We would prefer an amending formula to require native consent. We asked for native consent but that was something we had to Compromise however when the Constitution is returned the inuit will pick up the fight again he said. Indian Metis and inuit leaders have at various times protested that it was Only under duress during the Long constitutional Battle that the Federal Liber als gave them any recognition at All. Daniels said the Federal government and its officials treat native representatives As suckers be dealt with briefly and ushered quickly out of their offices ;
