Provincial consent vital court told by Michael Doyle Winnipeg free press Ottawa Canada is a voluntary Union of autonomous provinces whose consent is needed for constitutional change affecting them Manitoba argued yesterday during the opening round of a Legal Battle which will make premiers attack Ottawa by Cecil Rosner Winnipeg free press Thompson premiers of the four Western provinces put aside their poli tical differences yesterday and launched a joint attack on the Federal government s constitutional Energy and Cost sharing programs. In a bluntly worded communique the premiers attacked the Federal govern ment s approach of division and confrontation on these and other key issues. The Federal constitutional proposal is the most visible example of this new Federal government s attitude and is the most flagrant denial of the spirit of Canadian the premiers said shortly after the opening of their two Day closed annual meeting. Alberta Premier Peter Lougheed said prime minister Trudeau has no mandate from canadians to negotiate his unilateral constitutional package and he warned of a great division which this and other Federal actions could see premiers Page 4 or break the new Constitution. Manitoba chief counsel Kerr twaddle made a lengthy Complex and frequently forceful Case before the supreme court of Canada which lasted most of the Day and was to continue this morn ing. But he was under Tough no non sense questioning from several among the nine justices and he crossed swords with chief Justice Bora Laskin on Sev eral issues. Laskin at one Point forced twaddle to admit that Manitoba will accept Only unanimous agreement among the 11 governments As a method of amending the new Constitution or an amending formula that does not necessarily re quire unanimous agreement but which the 11 governments agreed to in the first place. Prime minister Trudeau has said the idea of getting All the premiers to agree is hopeless and Laskin made various comments that could indicate he also sees the problem As one of getting the country Dut of a deadlock. Approval rights the basis of Manitoba s Case yester Day was that either legally or by convention the provinces should have had the right to approve or disapprove of a new Constitution. In the process of making its Case Manitoba also said d it is illegal for a Federal minister to counsel the Queen to pass the Constitution through the British House of com Mons without provincial consent. D although provinces Are Sovereign and autonomous and in All but two cases joined Canada under a voluntary compact they Are constituent parts of the nation and the province is not making any kind of a Case for separa Tion.
