Lawyers for Sandy Harper plan to ask the supreme court of Canada to quash the indictment against him. Harper his estranged wife Are jointly charged with murder in the 1959 death of John Down then her husband. The application for leave to Appeal to be filed by lawyers David Margo Lis Ken Zaifman will delay the trial by at least a month. Margolis said the application will be based on the ruling by the supreme court last december granting mrs. Harper a new trial. Margo Lis contends the joint charge is a violation of the supreme court order which dealt Only with the indictment against mrs. Harper earlier this week the Manitoba court of Appeal unanimously upheld a ruling by the court of Queen s Bench rejecting the application to quash the joint indictment.
