Union Council suspends Winnipeg free press wednesday june 3, 1981 3 by Manfred Jager the Manitoba Council of health care unions has suspended the Manitoba paramedical association from Active membership because of the rates the striking Union is charging St. Boniface general Hospital for essential service. Dick Martin chairman of the eight Union Council said in a statement yesterday the suspension was decided on after the Council found itself at logger Heads with the paramedical workers who follow a policy of charging triple time for essential services work in strike bound hospitals. The Council includes locals of the Canadian Union of Public employees the institutional employees Union the Manitoba organization of nurses unions the Manitoba government employees association the United food and commercial workers the International Union of operating engineers local Park adoption backed the concept of a City owned Park maintained by area residents was approved in principle yesterday by Winnipeg s finance committee. The Assiniboine Park fort Garry group which suggested the adopt a Park concept to the City however lost out on its request to have the City Purchase .65 acres of land on Michigan Avenue. The committee turned Down that re quest saying the proposed Park is too Small too expensive and the area has an abundance of existing and anticipated Park space. The finance committee did approve however a recommendation that the City attempt to lease the property which is privately owned and estimated to be Worth some the committee approved a general recommendation from City staff that future adopt a Park proposals be favourably considered Only in situations where the subject property is currently City owned and preferably in a Deve loped state. Six existing Sites it also adopted the recommendation that proposals be approved Only if the citizens group adopts or assumes responsibility for maintain ence and Protection of the Park up to departmental standards. With reference to the Michigan ave nue site City staff noted that the neighbourhood already has some six existing Sites totalling 32.38 acres of open space. Staff also termed the proposed Price difficult to City staff have just recently completed a study of Parks and recreation open space in the City and out of that study recommended a minimum size of two acres for a neighbourhood Park. A site of less than two acres tends to become singular in purpose and not conducive to planning multiplicity of program and activities which More appropriately reflect the diversity of use of any residential u of m professor Heads Law society Winnipeg lawyer f. Turner a full time professor at the University of Manitoba Law school was elected at the annual meeting of the Law society s governing body in Brandon last week. Bob Strong executive director of the paramedical association said he was informed of the suspension yester Day and regretted the Council s step. However Strong said the action is unlikely to policy on Tri ple time rates for essential work assignments. St. Boniface general Hospital has called on the strikers for essential work extensively since they walked out of 10 provincial hospitals in support of higher wages May 21 and 25, Strong said. Calls from other hospitals affected by the strike have been on a sporadic to frequent basis. Martin who is also president of the Manitoba federation of labor with which the Mpa is not affiliated said the health care Union Council s policy is to Supply essential services during a strike based on the expressed needs of a strike bound health facility with re numeration at straight time rates. In cases of additional emergencies an arbitration Board would make in Stant decisions on More essential ser vice Supply Martin said. All such essential service workers would Only be available however As Long As the health institution involved does not employ strike Breakers or permit volunteers to take Over duties of strikers. As Well Only which continue bargaining toward a strike settlement retain their eligibility for essential service labor Supply Dur ing a strike. Strong said the health care Union Council s essential service policies were agreed to by his group As Well but never did spell out the rate of remuneration for essential services performed during a strike. Moreover he said that none of the hospitals now the target of strike action have Ever expressed an understanding that essential work would be at straight time pay Only but have acquiesced with the Mpa s triple time pay Rule. Since said rates of pay were not covered in the essential work policy of the Manitoba Council of health care unions Strong said he saw no need to change pay policy in response to the Council s move to suspend the parame group the Manitoba federation of labor is stepping up support for striking Csc technicians. Therefore he had no change of address to report. That being the Case there was no breach of the policy and aut Opac is bound to cover the no authority the judge said even if he is wrong in his interpretation Section 32 of the Public insurance act does not provide authority to cause forfeiture of insurance benefits because of any breach of the regulation. Counsel could not refer the judge to any other Section of the act that would entitle aut Opac to refuse benefits. An aut Opac lawyer had argued a breach of regulation releases the corporation from any responsibility. If the act intended that any breach of any provision of the act or of any regulation would or could result in forfeiture such a provision would surely appear in Section the judge said. To be effective it must therefore be precise and any ambiguity must be resolved in favor of the individual who May be
