Lawyer Rick Henderson arguing the Issue out of his own interest told the court that the provincial statute which prohibits motorists from driving with radar warning devices As Well As from installing them in their vehicles is beyond the province s authority. He said the radio communication Field Falls under the Federal radio act. Under the Federal act commercially sold radar detectors can be installed in motor vehicles As Long As they Are not used to deliberately avoid Speed traps. The Manitoba Highway traffic act prohibits motorists from equipping a vehicle with radar detection devices. Henderson said he was t asking the Appeal court to legalize the use of the devices but rather to decide which of the two authorities should prevail. In March county court judge Patrick Ferg upheld a provincial court ruling and dismissed the Appeal of a conviction of a Man fined under the provincial act. In the dismissal Ferg called the arguments of Henderson defence counsel in the Case thin and unconvincing and cited cases in Alberta and Ontario in which legislation prohibiting radar warning devices has been found to be within provincial jurisdiction. Crown counsel Stu Whitley said the whole purpose of the provincial act is to govern highways and the traffic on them. He added the provincial government has the right to regulate travel on highways.
