8 Winnipeg free press monday june recording system blamed for extra fee on parking Fine by Brian Cole provincial court officials say some Winnipeg motorists Are being charged an extra fee when paying outstand ing parking fines because of an inadequate recording system. Attempts to determine the status of parking tickets however revealed Many offenders could have avoided the extra fee if they were Given proper information by clerks and magistrates working in the Public safety building. The problem revolves around the method of collecting fines for parking tickets and the willingness of some clerks and magistrates to locate information relating to an outstanding lick Wayne free press City it or advise an offender How the Fine May be paid. Under the current system an offender who ignores or misplace a ticket will be sent a yellow notice Sheet which if ignored will be followed by a Green summons containing the Date set for a hearing into the charge. If the Motorist fails to attend the hearing the court May Issue a warrant for arrest or set a Date for an sex Parte hearing. The summons states the charge can be disposed of with a guilty plea during court office hours. But because records of this nature Are filed manually by the ticket number a person is unable to pay the Fine and avoid going to court unless he presents the summons or knows the exact court Date or original ticket number. Officially the staff in the clerk of the court s office is supposed to search the files for information relating to the ticket or advise the offender of one of several other ways to avoid incurring an additional Fine said Dan Dow Benko chief magistrate in the clerk of the court s office. For example a person who has mis placed his summons could be advised to make weekly checks with the clerk s office to see if his Case is being dealt on traffic court Day which is usually tuesday. Dowbenko also said if a person misses the court Date stated on the summons the staff could hold on to the summons and allow the person to pay the Fine before the charge is dealt with at an sex Parte hearing. Dowbenko added that an exception to this Rule May be made Tor a person who has a negative attitude or does t Supply the clerk with enough information. But several employees in the clerk s office including one magistrate who refused to give her name have said at various times during the last year that there was no alternative to paying the extra Fine. Instead they said an offender must wait until he receives a White letter informing him of the sex Parte hearing. Because the person who issued the ticket usually must testify at the hear ing he is paid a witness fee of a fee which is passed on to the offender. As Well following the conversation with Dowbenko a request to two of the people working in the office that a Check be made on whether there were any tickets awaiting an sex Parte hear ing was rejected. One clerk denied that such checks could be made. Another said it was t up to her to Check for any matters set aside for sex Parte hearings. Deputy administrator of court ser vices Wally flattery agreed some of fenders were being refused a Chance to pay fines at a lower rate and blamed the system for the problem. We know what the problem is and we feel completely frustrated about it and we re trying to get rid of he said in an interview. He explained that the courts do not keep track of tickets or summons by the name of the offender and that a person would have to manually search their files for hours in order to locate the summons. However he said officials were attempting to eliminate the problem by computerizing the entire process so All tickets would be keyed on the name of the offender. Lorimer to miss meetings Winnipeg school division s new chief superintendent won t be attending school Board meetings on a regular basis. Wes Lorimer was appointed interim superintendent last month to replace Harold Pollock who left the Post by Mutual agreement with the school Board. Board chairman Mira spi Vak said in an interview that while Lorimer is the Divi Sion s chief executive offi cer he works for the division half time and is not obliged to attend the Board s weekly meetings. Spivak said Lorimer is paid on a daily rate rather than a salary but the rate is based on the same salary Range As Pollock a to a year. No doubt Spivak said she has no doubt Lorimer can serve As interim chief executive offi cer without attending Board meetings at which trustees set policy because other superintendents will be there. Lorimer was division superintendent from 1953 to 1967. As Well Lorimer will be represented at Board meet Ings by Dave Downie his executive assistant. Dowrie said he will be the chief operating officer on a Day to Day basis because Lorimer also has responsibilities As chairman of the provincial universities Grants commission. Spivak said she Hopes the division can hire a new superintendent to replace pol lock by the end of the year.
