As a result of his forced retirement Newport complained to the human rights commission which established a Board of adjudication. Adjudicator Marshall Rothstein ruled that the civil service superannuation act which Calls for compulsory retirement at 65 takes precedent Over the provincial human rights act. Earlier this year the Manitoba court of Appeal decided the human rights act prevented the University of Mani Toba from enforcing a mandatory retirement clause in a collective agreement. The Appeal court stated a clause forcing University prof. Imogene Mcmire to retire at 65 was invalid because it violated the human rights act by forcing a person to retire because of age.
