Hamilton heard the Appeal of Aubrey Newport a former Deputy registrar of the Manitoba court of Appeal who was forced to retire from his Job in november 1978, after he reached the age of 65. Adjudicator Marshall Rothstein ruled that the civil service superannuation act which Calls for compulsory retirement at 65 takes precedent Over the provincial human rights act earlier this year the Manitoba court of Appeal decided the human rights act prevented the University of Mani Toba from enforcing a mandatory retirement clause in a collective agree ment.
