Winnipeg Free Press (Newspaper) - March 1, 1988, Winnipeg, Manitoba 12 Winnipeg free March provincial court judge Frank Allen has released the fallowing transcript of his interrogation by police in the continuing investigation of alleged ticket the judge was questioned by traffic Wayne King of the Winnipeg police Allen provided the 17page Tran from which the Lar has taken King the first matter that i would like to touch on is in regard to a gentleman by the name of Irving Allan King i understand that Bubis got a speeding ticket on the of and 1 understand that you were involved somewhat in this Allen that Correct i King i wonder if you can Tell us what your involvement was Allen Bubis got the Hes a Friend of i happened to be in his place of business one he told me that he was prepared to pay the but he thought that the Fine for what had happened was extremely High and told him that i didst involve myself in such but i would speak to a Justice who so 1 took the i put it in my pocket and i forgot about it until it must have been around the Middle or the latter part of no Bubis called me and asked How much he owed on the ticket and i told him i had forgot ten the thing and i would have to pay it for him and id get the Money from him 1 proceeded again to forget about it for a few hut one Day i was Down in Dan Dowbenko the clerk of the who is a Justice of the peace i expressed myself in some Way that i had forgotten about it and told Danny that this Man Bubis was prepared to pay but he thought the Fine was High and would he please phone Here Allen names a magistrate and see what the magistrate might be prepared to do Ami i told Danny whatever had told 1 cant recall that was and 1 left his King so just to clarify what you Are saying you gave the ticket to Dan Dowbenko in his King and then you left before he made the phone Allan King did you suggest to him who he should phone Allan i mentioned Here Allen name a King any particular reason Why that Allan because that that the work he and anytime Ive taken a ticket Down to former traffic superintendent Allen or some body for Hes who Hes told me logo King did Dan Dowbenko finally Lel Hal the outcome King How did you expect Bubis to pay the Money to Dan when they didst knew each other Al 1 Lold Dan 1 would pay the Money King and he never got a Allan i never heard from him and you never made any Allan 1 forgot about King l might suggest that Dowbenko Story is slightly i Teien he says that you were l Here Shioi shout the conversation with ih1 Al Len no King there was another pair of tickets that were received by a fellow by the name of Lin quo i i Huu Lold you his whole lust know him As i understand that on the Asili of Hixie All received a Raff in offence one for speeding and one for failing to n Strain Hildren in the vehicle Allan i i also understand thai a a waiter at Dubro mks that King and i understand thai Sinie Contact with turn m to these tickets Ai i in Ali was telling me one about the illness of his Daugh was in 1 dont i h one she was very i Iii and he Mem e i i he d fallen i he Iii the i i lip to tile in see i of of i the i l pm ill i j Umpei the co cum a i e i Kmil my i i judge Frank Allen was questioned by police in their probe of alleged ticket transcript released of police interview remanded or reprimanded he might have acquit Ted 1 dont King in fact he annulled him on both Allan i didst know King did you eventually Tell All of his Gotzl Fortune Allan i told Well actually i had spoken to him before i saw the magistrate and said that the tickets had returned to me and he might have to pay them and then afterwards 1 went Back and told him that it was Okay that it was looked King i show you a ticket with the name Andrew Allen on Churchill who was apparently operating a vehicle owned by Frank could that be your son and would that be1 your vehicle Allan 1hats King and i see Here a Date Allan that King and the magistrate in thai Case would be the magistrate previously referred 1 see the disposition in this Case was a reprimand in regards to a speeding is that Allen i dont if that what the paper i dont know anything about King Ami you have no personal knowledge of Allan King theres another ticket Here in the name of Frank woo Ami the Date on this is the Isth of december ties is a red Light and again the magistrates name appears on this and thu was Deal with in of 1co Allan youre King again i was red Light Gaui u was a Sivji Allan k got to do with me King veil you know most Eli Hes my brother in Law Hilt do you know anything Athit the Mailer Allan absolutely not King Good now 1 won Der if we can go if i can just draw attention Back to and tha the differ ence of opinion m would or at least the difference in the i Neilio r Lii at doa Miiko Ifie Al t i King and if Bubis in this Case didst have you As a Friend or someone else As a Friend under similar someone in the Legal he have that hed either have to get a hire one which is a lawyer who is empowered to act in his behalf under the circumstances or hed have to go Down in dont you feel that Correct Allen so i guess hed have to make the communication in some King directly himself Allen who says it has to be directly himself King so in the Case of would you elaborate a Little bit on your relationship with him Allen he is a waiter in the Dubrovnik the Dubrovnik restaurant is a restaurant i used to frequent quite a bit when my office was 1 still go in there occasionally and that my relationship with Ali and Over that time Ive become a Good a i guess i never knew his full name until i saw the tickets he gave me and i re member it after Hes still Ali to me and i repeal it to you now even though you read it to me a few minutes King and you received the tickets from him where Allen in the King so As you recall it was Mac Allen that suggested thai you go Down and see the magistrate about Allen King we have a state ment from Mac Allen in that he denies that he had any idea who was going to be seen on these and denied that he told you that you should see the magistrate Allan Well i doubt that very King do you feel it was proper that you went to see the magistrate on behalf of Allen yes 1 King and it was proper that in got acquittals on Xith of these tickets Allen King without personally appearing himself to argue his de Allen there Are two p that so fur As him pt1 orally i think that was Fine for me to go and speak on it on his so far As the acquittals Are hut was the magistrates decision u is Well within his King do you think that without having heard from the la that going into someones office and discussing it on inhale of an individual when you Are an officer of the court tax Normal course of events Allan because first of All they did hear from i he policeman the policeman has a written report in thai is number which the magus Raie checked when i Well and spoke to him and number that is the proce Dure that is Secl up now if the police dont like that youd better get the statute Amend Evl thai is the procedure that is set up by Law Iliin i Luil the Pic cure thai i up Eil Hei the individual goes to St the Mug i or he he soon Eloiie go to see i he he goes u i l a uie Hie Poi e Chance to say what happened and the other person has a Chance to say what and the Allen that is not right and you know it is not what happens on a continuous and understand that instructions Are issued to this and it is in accordance with the peo ple go they Settle Justice of they make their presenta they can even do it by it is provided for in the they make their and there is no provision for the police appear ing and you know that you dont want the police King 1 think if you play the tape you will see that i said that a person can go Down and appear before a Justice and plead his matter or he can have a defence lawyer go Down to plead his mat Allen he can have his grand Mother go King his grandmother Allen he can have anybody go Down under the any agent can go you dont have to have a King and again with your involvement in the do you think it is proper that you go Down and argue this cases on behalf of waiters at Allen i dont argue 1 went i told the Guys to the the Justice who was in he accepted i might say 1 have gone to justices in the past where they have not Leen prepared to buy i returned the tickets and told them to pay King just to draw join attention to the Bubis is Ere you aware that just prior to you involvement in the Bubis Mallei that Bubis was charged Oul convicted of speedup in Aii Kihei instance Allan i want King do you think in is fair then that he go a reprimand within a couple of Mouths of a similar offence Allen the Lei i think it is fair or not has nothing to do with King you dont think this ear Lier ticket is relevant Allen 1 think if you want to put a policeman Down there to make representations on these or if you want to in this report you file Wilh i that his Man has had so Many convictions and Pul it the it is ext Reinelt but when the Crown or he police dont Chouse to put the prior record be fore then 1 Ini Ilung to n k on when of dealt wilting closed circumstance n i Mailer if he had or it u Ikhine to 1 Oil Deal i the own ice 1 Deail with it in Dowbenko King but the Oher one i am talking Weie dealing with someone Allen eve us in hat where you tit Atiee saw him i can t counter i i sparse
