If the Law is a bother just change i it Paul Wiecek by does it seem sometimes that government expects everyone to live according to the letter of the Law except themselves take the Case of Dave Lindsay. In his bid to have a 1995 conviction for refusing a breathalyser overturned Lindsay discovered an obscure Section of something called the Law fees act that allows the poor to have their court fees a transcripts filing Etc. A waived if they Are declared paupers. That a the Way its supposed to work anyway. The Law has its roots in England was enacted Here decades ago to ensure the poor had Access to the courts. But when Manitoba introduced Legal in 1972, everyone forgot about the pauper Law. It has been collecting dust in the legislature Library Ever since. But Lindsay dusted it off recently As part of his efforts to Appeal his own conviction. And that a made the provincial government very uncomfortable. Lindsay maintains he never refused the breathalyser but simply asked police to allow him to speak to his lawyer prior to taking the test. After he did so was instructed to take it Lindsay says he asked a then demanded a to take the breathalyser. But he says he was told by police that head had his Chance it was too late. Which sounds like a reasonable basis for an Appeal in this Corner one which at least deserves a hearing in court. But in order for Lindsay to Appeal the conviction he needs a transcript of his trial the province wont give him one until he pays $415.80. Lindsay who makes just $6 an hour working in a warehouse has paid the first $150 but does no to have the rest. And Legal Manitoba has refused to cover his Appeal costs because of a policy that stipulates Only cases involving the possibility of jail time or Job loss Are covered. Lindsay is willing to represent himself in the Appeal but he believes he a entitled to have the Cost of the transcript a other administrative costs a covered under the terms of the pauper Law however old that Law might be. A a it a still the Law of the land a Lindsay said last week. The province however has refused. Assistant Deputy Justice minister Alan Fineblit explained the Law society previously issued pauper certificates but stopped doing so years ago when such requests dried up. And with no Agency issuing certificates any More Lindsay is out of Luck. A you can to pay for court fees with something that does no to exist anymore a Fineblit explained. But Lindsay believes the province has other reasons for refusing to give him a paupers certificate. A it would set a precedent that could end up costing the government Money a he said. A that a the last thing they want to do because with All the Legal cutbacks application fees now there a a lot of people who could take advantage of a Section like Lindsay makes a Point. Earlier this year the province trimmed $200,000 from the Legal budget handed Down an edict that will ultimately result in Legal taking on fewer civil cases. Last year a $25 non refundable application fee was also introduced. And if you re still not convinced the government takes All this very seriously consider this earlier this month the tories introduced a Bill in the legislature that formally repeals the pauper Section of the Law fees act. A Justice official said its just a housekeeping piece of legislation to wipe off the books a Law that a should have been repealed years funny that the province wont pay out under the Law yet feels its legitimate enough to formally repeal. So at a time when Legal appears to be on the government chopping Block the province responds to Lindsay a discovery by axing a Law that offers the poor some partial Relief. it be great to be like the government a changing the rules every time the game Isnit going your Way got a Story for our investigative reporter Call Paul Wiecek at 697-7411, fax at 697-7412 or write to 1355 Mountain ave., r2x 3b6.
