Nip Justice critic Gord Mackintosh said the province has a duty to protect the most vulnerable members of society. The demand follows a recent article in the Manitoba Law journal which paints a disturbing picture of the province s Justice department. Anne Mcgillivray a Law professor at the University of Manitoba reviewed a Case in which a 12-year-old Babysitter was raped by the 29-year-old Man who hired her. He was ultimately allowed to serve his nine month sentence in the Community. The Case grabbed National headlines last year when an Appeal court judge described the victim As sophisticated. While Mcgillivray takes Issue with the Bench on certain aspects her toughest remarks Are directed toward the Crown attorney s office. She uses words like inadequate neglectful and lax to describe their performance. Mcgillivray says the Crown s failure to interview the victim left gaping holes in the Case. Interviewing the child and her parents would have rectified falsehoods and introduced substantially dissimilar facts from those found by the courts wrote Mcgillivray. Moreover she Points out that a victim Impact statement was never requested nor was the victim told that the criminal injuries compensation Board would pay for private counselling. Different prosecutors in terms of Case management five different prosecutors handled the 13 different court appearances. Four of those adjournments were a result of the Crown misplacing the pre sentence report. As Well none of those involved had any expertise in dealing with these particular cases wrote Mcgillivray. The prosecution of this Case Falls Way below the standards expected by Manitoban said Mackintosh. Mackintosh said a special unit of trained prosecutors would help ensure that the rights of child victims Are adequately represented. The Filmon government has refused to acknowledge anything went wrong in the Case. When questioned in the House last year about the matter Justice minister Vic Toews declared there was no evidence that Crown attorneys did t do a Good Job. I stand beside what my prosecutors did in that Case Toews told the legislature. We have done everything that we possibly can to ensure that they victims remain an important part of the process so that the judicial system understands that they too have a part to a spokeswoman for Toews said the minister was touring the Northern part of the province and was unavailable for comment.
