ahead with plans to overhaul the arbitration sys tem for negotiating teachers salaries despite outside Legal advice that his actions could blow the lid off school division budgets and trigger tax Caldwell has let it be known for some months he intends to Amend the Public schools act to remove provisions introduced by the previous tory those provisions stipulate that arbitration awards in teacher contract Dis Putes must be settled primarily on the basis of the divisions ability to other issues such As transfers and class size and working conditions Are excluded from consider Caldwell has hinted he would like to see teachers contracts settled under the labour relations which would allow a wider Range of issues to be considered in including Quality of Edu cation and no monetary working con Caldwell has said he will not reintroduce a strike lockout the school divisions have argued that allowing an arbitrator to consider those additional issues would result in Esca lating costs that would inevitably boost property Caldwell dismissed such scenarios even though he received outside Legal advice that overhauling the arbitration system would Lead to massive Cost in a confidential briefing note obtained by the free lawyers contracted by the education department argued that allowing an arbitrator to consider the issues of Quality of education and working conditions would result in a higher Overall Cost to the system and would Only be effective if no Cost Limi tation or containment is the Legal opinion noted that divisions must achieve a balance Between Quality of education and ability to but that the changes Caldwell was consid ering would not strike the necessary in the arbitrator May inter pret such a provision As preventing him from doing Caldwell said that letter represented Only one of several outside Legal Opin ions his department has sought on the teachers arbitration and he disputed the letters assertion that expand ing the scope of issues to be considered in arbitration translated into higher property the Manitoba teachers society said it intends to hold education minister Drew Caldwell to his commitment to change labour i guess wed
