By Mary Vallis c hic ago Conrad Black the convicted Felon who was once one of the worlds most powerful press Barons will today be sentenced to up to 24 years in a Federal prison for stealing millions from Hollinger International inc. In the same Chicago courtroom in which lord Black of Cross Harbour was tried earlier this year judge Amy St. Eve will decide How Many years he will spend in custody. On july 13, lord Black was convicted of four criminal charges including three counts of fraud related to non compete payments he received during the Sale of Hollinger International inc. S newspapers Money the jury concluded should have gone to shareholders. Black 63, was also convicted of obstruction of Justice related to his videotaped removal of 13 boxes from his Toronto office. He maintains his innocence and intends to Appeal the Jurys ruling. St. Eve could order him directly into custody set a Date for him to surrender or allow him to remain free on bail pending the outcome of his Appeal. This is someone who in some ways seems to embody hubris said Peter Henning a former attorney in the u. S. Justice department who teaches at Wayne state University Law school in Detroit. He was convicted of abusing his position and he was the head of a Public company. His obligation was to protect the investors and instead he lined his own pockets. Federal prosecutors Are seeking a prison term of Between 19 and 24 years Blacks lawyers Are arguing he should receive a sentence closer to the 29 month sentence his former right hand Man David Radler negotiated. Legal experts predict that St. Eve will order the former press Baron to serve five to 10 years and will not order him directly into custody. In some respects this is the last of the major High profile corporate fraud cases from the Enron Era said Jacob Frenkel a former u. S. Prosecutor and former enforcement lawyer with the u. S. Securities Exchange commission. Whatever the length of the sentence now is the time to revisit whether sentences in these cases As a Rule have gone too far. The judge has also been asked to make her decision using sentencing guidelines from 2000, the time of the offences instead of the More stringent 2007 guidelines in place when Black was convicted. Blacks three co defendants former Hollinger colleagues Peter Atkinson Jack Boultbee and Mark Kipnis will also be sentenced today. They were originally convicted on the same three counts of fraud As Black but St. Eve last month acquitted Kipnis a former lawyer for the company of one fraud charge. Throughout the trial and the wait for his sentence Black has maintained his innocence and frequently criticized the forces that led to his prosecution.
