Com by Aldo Santin t he former assistant Deputy minister convicted last month of violating the provinces conflict of interest legislation for his dealings in a land development project has appealed the sentence and conviction. In documents filed in court Friday Stephen Kupfer said provincial court judge Marvin Garfinkel repeatedly erred in his understanding of the Law and in his findings of the facts and evidence presented at trial. Kupfer is asking the conviction be quashed or failing that the sentence be reduced. The Appeal will be heard before a Justice of the court of Queens Bench. No Date has been set for the Appeal. Kupfer was Given a $ 3,500 Fine and assessed costs of $ 1,750 on his conviction in late november. Kupfer was the first person charged under the 20 year old legislative Assembly and executive Council conflict of interest act. He was charged with violating the 12 month Cooling off provisions of the Law which prohibits Cabinet ministers and senior government officials from having any dealings with their departments after they leave government. At a three Day trial in Early october court heard Kupfer helped a numbered company buy a 6.3 hectare River lot the former site of the seven Oaks youth Centre in the Rural municipality of West St. Paul from the department he once managed. The land is slated to become a residential development and a seniors condominium. Aldo. Santin free press. My.
