Dallas Pruden Wilson and Terrence Sinclair surprised and angered the victims family Friday by appearing at their sentencing hearing and claiming the eyed been wrongfully convicted of manslaughter. They have filed a motion saying Queens Bench Justice Karen Simonsen did not properly consider the actions or inaction of a key Crown witness to the March 2005 tragedy. Adam Lecours 34, was seriously beaten and robbed by Pruden Wilson and Sinclair and then left unconscious on a darkened Street in the Maples Only to be run Over moments later by an unsuspecting Motorist. Emilia Rzedzian testified during their trial last january she saw the attack but was too scared to get out of her car and help Lecours after the culprits fled and he Lay on the Road. She called on her cellphone for help but Lecours was struck and killed before police or paramedics could arrive. Defence lawyers Randy Minuk and Roberta Campbell argued Friday their clients should not have been convicted of Lecourse death when its Clear Rzedzian had the Opportunity to Rescue him and control the scene. The question is should they be held responsible and we say no said Minuk. Crown attorney Steve Johnson said the motion by the duo is devoid of Merit and should be immediately dismissed especially since lawyers had the Opportunity to raise the Issue during the trial but failed to do so. This is not a Case where fresh evidence is being presented he said. And the last thing the killers should expect is for some Good Samaritan to come along and clean up the mess they made. These types of courtroom memorials have become routine during recent murder and manslaughter sentencing. Defence lawyers objected and Simonsen agreed. Court heard the teen Pruden Wilson and Sinclair had been drinking at a nearby House party when they decided to go outside and Rob someone. By Lindsey Wiebe bar goers could see tighter Security at City nightclubs after the province accepted More than a dozen recommendations aimed at making pubs safer. The report from the Manitoba liquor control commission released Friday comes on the heels of two violent clashes at a downtown nightclub in recent months. It contains 13 recommendations for stepping up safety at drinking establishments including mandatory criminal record checks for managers and a required Security plan for anyone looking to open a new bar. Existing clubs wont be off the Hook either. The province wants to require bars to shut Down following a serious incident and undergo a full risk evaluation. To open again owners would have to meet safety requirements like adding More Security staff or beefing up Security systems. In the Case of serious or repeat problems bar operators might have to Post a Bond against their liquor licence. Just How much the eyed be required to pay a snot been decided. Bar patrons had differing opinions about the new safety measures. Koepke would like to see More Metal detectors in bars. Finance minister Greg Selinger a hons responsible for the liquor commission stressed there is no one size fits All approach to bar safety. There Are also no plans to make Metal detectors mandatory said Selinger who believes they May give a false sense of Security. There Are Many ways for people to engage in violent activities that dont require Metal he said. Some recommendations could take effect Over the next few months said Macc head of inspection services Winston Yee like the record checks and Security plans. Others would require legislative changes and will have to wait until Spring. The report was prepared by a group made up of police officers Justice officials and liquor commission staff As Well As representatives for hotel cabaret and restaurant owner associations. Other recommendations include More Public education As Well As a set of Industry Best practices like Banning known troublemakers. Bar patrons could also see More police officers around nightclubs in the future. Yee said police Are in favour of maintaining a stronger presence in areas where theress a higher risk of violence. The Empire cabaret which sparked recent controversy Over nightclub safety is set to appear before the Macc next month. The main Street bar has been closed since mid november when a 24 year old Man was stabbed to death at the club. A few weeks later four people were wounded in a shooting at the same location.
