He feared the worst if he gave in to the urge to fall asleep. I was trying to stay awake because i thought i was Gonna die Murray testified in court wednesday. Murray one of a team of officers conducting a drug raid on a Jubilee Avenue Home in december 2006, sought shelter in a room not far from where he had been shot in the Abdomen after trying to open a bathroom door in the House. The Veteran officer and two others with the Winnipeg police service were injured by gunfire while exercising a search warrant at the Home of Daniell Anderson. The 22 year old allegedly barricaded himself in the bathroom and opened fire. Anderson has pleaded not guilty to attempted murder and weapons related charges stemming from the incident. Murray has undergone three operations to repair the damage caused by the gunshot he testified. He has not yet returned to duty nearly two years later. Two other officers const. Jeremy cull and const. Curtis Penner were also injured. Only cull injured by an errant police Bullet that struck him in the leg has been Able to return to full duty. Murray said he remembered hearing five shots ring out in total. I heard two shots from a Shotgun and then crack crack crack from our service pistols Murray said. In later testimony wednesday Penner recalled standing near a doorway where Murray was injured and witnessed a Blue Light coming from the bathroom As the shot rang out. During Cross examination defense lawyer Roberta Campbell questioned Penners ability to recall accurately the incident As it unfolded and claims Anderson surrendered without incident. But still up in the air is what will happen to special prosecutor Marty Minuk who was heavily criticized in the report for being unprepared to handle the Case against the sex police officer charged with killing Crystal Taman in a 2005 Highway crash. Minuk is still under contract with the province to provide Legal advice and courtroom services when a regular Crown attorney cant because of conflict of interest concerns a Justice department spokesperson said. Minuk is still handling a number of files including a High profile one involving two City police officers charged with perjury. Chomiak said the province cant suddenly end these contacts since a new system has yet to be created. It will take weeks to do that he said. To Cut contracts outright would jeopardize cases that Are ongoing he added. Minuk was hired by the province to prosecute sex cop Derek Harvey Zenk for Tamanis death but Minuk was hobbled by a bad police investigation and tainted evidence about Harvey Zenkus possible impairment. In a controversial plea Deal Harvey Zenk was convicted of dangerous driving causing death and got a conditional sentence of two years less a Day House arrest. Taman inquiry commissioner Roger Salhany said in a report released monday that Minuk was unprepared and plea bargained away a stronger Case. Minuk essentially got nothing of value in return for the Deal he agreed to but gave up much Salhany said in his report. Moreover he failed to prepare adequately before resigning himself to the Deal he made. Minuk has already been removed from one Case because of his connection to the Taman Case the provincial inquest into the 2005 police shooting of Matthew Dumas. Sources in the Legal Community said Minuk is devastated by the criticism. The provincial spokesperson said Minuk still has a number of other cases on the go with Manitoba Justice including other inquests criminal cases and matters where a Crown opinion is required.
