Many residents say grizzly sightings have increased in recent years and the animals May be getting pushed out of their regular habitats by people on tvs and other motorized vehicles in the Foothills. Meeting organizer and Farmer Candy Scott said people Are particularly concerned because Wagner died so close to Homes. This Isnit a Remote area. This is a highly populated Rural Community Scott said. The supreme courts decision amounts to a Victory for press Freedom because it Means that a ruling in the Ontario court of Appeal last March which reinforced the principle of open courts still stands. The Appeal court ruled that an Ontario judge was wrong when he ordered the documents in question be sealed. The Case stems from a 2006 injunction from an Ontario judge freezing the worldwide assets of Black and his wife Barbara Amiel Black. When the Globe and mail Learned Hollinger had obtained the injunction against the Blacks the newspaper went to court asking the documents be made Public. The judge however said Public Access to the sealed material could jeopardize the fairness of Blacks criminal trial in the u. S., which began six months later. The Ontario court of Appeal in overturning the earlier decision concluded the judge erred in principle by failing to give sufficient weight to the constitutional guarantee of press Freedom and the principle of open courts. Public Access to the court system promotes Confidence in the judicial system and enables oversight of the functioning of the courts said the Appeal court. The Appeal court noted that the Issue in question is now moot in Blacks Case since he has been tried and convicted. The Case arose from a 2005 lawsuit that Hollinger filed against Black and the company requested his assets be Frozen to ensure he would still have Money to pay if Hollinger won.
