Store hours the Story s Haun Burky 34, was walking on Pembina Highway on april 14 near the University of Manitoba when a Light pole slammed him to the ground. Gusting winds up to 80 Kilometres an hour knocked Over the pole striking him in the head shoulder and Back on his right Side. His Arm was paralysed he said and he spent 10 Days in the Hospital after the Accident. This is a very serious and maybe a lifelong injury. There Are Days that Are really Tough Burky said. Id like to think that ism dealing with it As Well As i can under the circumstances but its Tough. Burky suffered nerve damage numbness in his right Arm and shoulder a spinal Cord injury scarring and depression. He filed a lawsuit against Manitoba Hydro in june saying the injury will prevent him from working in his profession. Burky who was a waiter for almost 15 years until the Accident will need to go Back to school to get a Job that does not require the use of his Arm. You cant be a waiter with one Arm put it that Way Burky told the free press in june. They re not even sure that the pain will go away. He sued Manitoba Hydro for general damages loss of past and future income and All medical costs related to the Ligh Standard injury. Manitoba Hydro spokesman Glenn Schneider said shortly after the incident that rust on the base probably led to the pole being uprooted. Since the lawsuit was filed Manitoba Hydro has refused to comment on the Case. Whats happened since Manitoba Hydro responded with a statement of defence on sept. 2 claiming it Isnit responsible for Bur Kyts injuries because the pole was properly inspected. Shortly after the Accident a Hydro spokesman said the Light standards Are inspected every four years. The one that fell on Burky was last inspected in 2005 and no rust or damage was reported. The City of Edmonton is director of signals and Street lighting Gord Zebryk said perfectly Good poles dont fall Over. However some poles can corrode from the inside out due to moisture making the rust less visible. The outside of the pole looks Fine but when you conduct certain tests you can find out that the thickness of the Wall is compromised and is thinner Zebryk said. We have a number of tests we can do to find out the Wall thickness. To get a closer look at maintenance reports for the pole that fell the free press filed a Freedom of information request with Manitoba Hydro. It was denied. While Burky awaited a court Date for the Case he went to Calgary oct. 1 for surgery to repair the nerve damage. After the surgery Burky had More than 50 stitches and three Large scars. He spent five Days in the Hospital before he was Well enough to return Home to Winnipeg now its just a wait and see game. They did several different nerve transfers and one could take and the other ones might not take he said. And if they do take there is no guarantee ill recover. Burky has continued with physiotherapy he sees a pain psychologist and has struggled to get by with the use of Only one Arm. Sleep is Tough. My sleeping patterns Are different because some nights my Arm hurts More than others he said. Sometimes the pain transfers into my dreams and ism up All hours of the night dealing with the pain. What happens next Burky will continue to do therapy and he May need More surgeries to help fix the nerve damage. All i can really do is continue with physio and just give it time and Pray he said. There is not much i can do other than let my body do its stuff. Without the use of his right Arm he cant Wash his hair with two hands has trouble cooking and cant do a lot of Basic Day today tasks he said. Hers working with an occupational therapist to help adjust How he performs Basic tasks. The next step for the lawsuit is a pretrial examination for discovery in late january Bur Kyts lawyer Martin Pollock said. This has been a devastating injury. He flew Here to meet for the first time his 17 year old Winnipeg Girlfriend whom he met on the internet two years earlier. She and her family were at the Airport to Greet him. But things did not go As planned when police found images of children As Young As two engaged in sexual acts purportedly with the kids fathers. Stenstad Volden thought he had earlier erased All the abusive photos from his computer. He admitted to downloading the images As he used to be interested in incest Canadian Border services Agency lawyer Maria Dejaeger said. Stenstad Volden pleaded guilty tuesday in a Winnipeg court to a criminal charge of importing child pornography on a Laptop computer. Judge Michel chartier gave him double time credit for 45 of the 54 Days he already served along with three years of probation. Ninety Days in jail is the minimum sentence for a summary conviction for importing child pornography. Stenstad Volden was incarcerated in a protective custody unit at heading Ley jail because a deportation flight could not be arranged for him during the holidays. Nupponen said there was nothing preventing Stenstad Volden from finally meeting his Girlfriend if she chooses. I dont see theress any element of danger in that Nupponen said.
