T he child and family services general authority is contemplating a human rights complaint after two of its Young charges were barred from a local restaurant simply because they were in Foster care. Were still investigating said Jay Rodgers the authority yes ceo. If this is what happened appalling is the word i would use to describe their treatment. Shortly before Christmas a cos worker was told that she and the two Foster children she was supervising were not Welcome at a hotel restaurant. In fact said the restaurant manager it was policy that no kids in care were allowed to eat there. Instead the teenagers who were being temporarily housed at the Howard Johnson hotel on Portage Avenue were told the eyed have to eat in their room. When we went in to order breakfast i guess they looked at our room number and knew these were kids in care says the worker. We were told the order would have to be to go because they were Foster kids. The worker who was once a child in care herself was outraged. They said it was policy. They were kids in care and they we rent allowed in the restaurant. Whats next separate lunch counters different drinking fountains lets be Clear the province of Manitoba was paying to House the kids at the hotel something that is done Only in emergency situations. These reluctant hotel guests were then told they use the facilities they were second class citizens. Out of sight out of mind Isnit that one of the biggest problems facing kids in the child welfare system after a lengthy debate the two teenagers and their two staff workers were eventually allowed to eat their breakfast in the restaurant. First though the workers had to Promise the eyed pay 100 per cent of any damages caused by the kids. Remember these girls had never set foot in the restaurant before. Dan Carlson general manager of the hotel says hers not convinced there was Ever a Blanket policy barring cos kids from the restaurant. However the restaurant is rented out by the hotel Chain and its manager sets his own rules. There have been some times when some kids a vent behaved says Carlson. There May have been times in the past when kids we rent allowed to stay but that would be no different than an adult who was being disruptive. The Point is now moot. The restaurant owner moved out two weeks ago. The new owner Jimmy Alexiou says hers got an open door policy. I am open to anything As Long As people have half decent behaviour says the affable Alexiou. Its open to everybody As Long As you dont bother anyone. Thatus for everybody adults kids every race. And then Alexiou said something that showed a rare Wisdom if you dont reach out to someone with a problem the problem will reach out to you. These kids have problems we All have problems. We have to be Nice to each other. The cos worker says the Saddest part of the whole experience was the teenage girls in her care we rent shocked by the discrimination. They re used to this kind of stigma she says. These Are the sweetest girls. Being treated like a criminal before you Are leads to More problems. Whats bad is All these people think these things about you and you eventually believe it. Its Likely the former restaurant owner had problems with cos kids. He probably also had problems with obnoxious adults too. You and i have had to put up with jerks who get drunk and Rowdy in Public or yahoos who shout on their cellphones while were trying to have a quiet meal. If theress a problem we expect management to Deal with it. But to Deal with a problem before it happens and to assume All cos kids Are troublemakers really is the worst form of discrimination. As Jay Rodgers said its appalling. Lindor. Reynolds free press. My. Ca a ruling on a two year old court Case Over Metis Hunting rights will be heard in a Brandon courtroom today. While provincial court judge John Combs will decide whether will Neal Goodon can Hunt without a Manitoba Hunting licence a constitutional expert said the cases Impact is not about Hunting. This is not about the right to bag a Deer said Karen Busby a University of Manitoba Law professor. The real Issue is if the Metis have the right to Hunt then they have the right As a Community to be consulted and compensated if there is development on their traditional land and that is the big Issue. Goodon is a Brandon area resident but grew up in the Turtle Mountain Region near Lake Metigoshe. Goodon 40, has pleaded not guilty to illegally possessing captured or killed wildlife under the provinces wildlife act. His trial has proceeded on an on again off again basis since May 2006. Closing arguments were heard in november 2007. Crown and defence attorneys agree that Goodon shot a ring neck Duck near Sharpe Lake on oct. 19, 2004. He told a Manitoba conservation officer he shot the Bird with the authority of his Manitoba Metis federation Metis Harvester identification card which he said nullifies the need for a provincial Hunting licence. During the trial Good ones lawyers argued the wildlife act is unconstitutional because it does not recognize Good ones aboriginal right to Hunt for food under Section 35 of the Constitution act. Previous supreme court of Canada rulings have said Metis rights to Hunting Are restricted to Community rights to an area where they traditionally hunted. The Crown has argued that the supreme court said the Metis Hunting right applies Only to a specific location with a consistent history of Metis activity and in an area that predates european Rule. The Crown also argued that the Turtle Mountain Metis did not exist before Manitoba was established in 1870 and that the Turtle Mountain area had been the traditional territory of the red River Metis. But the red River Metis Hunting rights were extinguished when the red River settlement entered Canada. Busby who has been eagerly waiting to Days ruling said Ottawa and the province Are not concerned about How Many ducks or Deer Metis Hunt or whether they do it with our without a provincial Hunting licence. Busby said that if Combs rules that the Metis do have traditional Hunting rights in the Turtle Mountain area then that also Means the Metis and their representatives have to be consulted about any development. Busby said a proposed Oil pipeline is slated to go through southwestern Manitoba into the United states. It would Cross through territory that has been portrayed As traditional Metis land during this Case. The governments opposition she said is fuelled by concern that future consultations and any possible compensation could complicate or jeopardize development. Several first nations who also claim the land have threatened Legal action Over the proposed pipeline. Busby said that regardless of the trials outcome its Likely that this Case will be appealed by either Side. Its a real Safe bet we can expect to see this and other Metis rights cases go to the Manitoba court of Appeal and the supreme court of Canada. Aldo. Santin free press. My.
