T HE financial industry is swinging
back at a one- time adviser who is
suing his former employers.
BMO Nesbitt Burns and National
Bank Financial have each filed counterclaims
against one- time successful
planner Doug Warkentin, wanting to
recover $ 1 million they gave him in the
form of loans and bonuses before each
let him go.
Warkentin went to work for BMO
Nesbitt Burns in August 2011 but was
fired in January.
Before working for BMO Nesbitt
Burns, Warkentin was a star financial
adviser with Wellington West. Warkentin
alleges he was forced to quit in July
before the local investment firm was
taken over by National Bank Financial.
Warkentin filed a suit against BMO
Nesbitt Burns in March, alleging the
firm hired him last summer just so
it could get his lucrative $ 70- million
client portfolio and then fired him.
Warkentin filed a suit against National
Bank Financial in April, asking
the court for an injunction prohibiting
its staff from attempting to lure away
his clients and unspecified general and
punitive damages for alleged actions
taken against him.
The allegations have not been proven
in court.
In a statement of defence filed recently
at Queen’s Bench, BMO Nesbitt Burns
denies the allegations and says its local
official was unaware of the extent of
Warkentin’s trouble within the industry,
which was the reason he was let go.
National Bank Financial filed a statement
of defence and counterclaim last
week, stating Warkentin had signed
several releases before he left Wellington
West, and he has no grounds to pursue
legal action against it.
National Bank Financial claims Warkentin
still owes it about $ 355,000.
BMO Nesbitt Burns claims Warkentin
owes it $ 740,000.
In court documents filed in March in
the action against BMO Nesbitt Burns,
Warkentin said he was facing an investigation
by a regulatory agency for
falsifying personal financial documents
while at Wellington West. Warkentin alleges
he told BMO’s local official about
the investigation, but BMO alleges he
didn’t provide all the details.
The Investment Industry Regulatory
Organization of Canada held hearings
into Warkentin’s alleged offences in late
May. A decision has not been reached.
Warkentin filed a reply to the statement
of defence from BMO Nesbitt
Burns, repeating his earlier allegations
and insisting he and his former lawyer
told BMO everything about the pending
investigation against him. He asked the
court to dismiss BMO’s counterclaim.
