The Transcona Country Club and the Transcona Lions Club filed a statement of claim in the Court of Queen's Bench that alleges the city failed to control water service between May 29 and June 15, 2010, and caused damage and " substantial operating losses" to the business. The claim alleges the city allowed the sewer system to surge with rain water, which damaged the country club's sewer line and led to sewer backup in the basement. In late May 2010, a torrential rainstorm walloped Winnipeg and parts of southern Manitoba, dropping 80 millimetres of rain in the city over the course of a weekend. Over 350 homes had some water backup. Club officials allege the city did not shut off the water service to the property to limit the amount of damage, which " exasperated repair efforts" and increased costs, according to court documents. The allegations have not been proven and no statement of defence has been filed in court. Officials from the Transcona Country Club could not be reached for comment on Monday. City of Winnipeg officials said they do not comment on matters before the courts. Older neighbourhoods in Winnipeg have combined sewers, where one pipe carries both wastewater and runoff from rain and snow. Normally, this liquid goes to a wastewater treatment plant. During periods of heavy rains, sewer systems are overloaded and the rain water and wastewater may back up into homes. According to the City of Winnipeg's website, homeowners and businesses are responsible for the sewer pipe that runs from their building to the city's sewer main. Residents and businesses can take out an insurance policy for sewer backup, and the website said the City of Winnipeg is " not responsible for sewer backup unless we have been negligent." jen. skerritt@ freepress. mb. ca IT'S not a rain delay, but more a case of getting things done well before deadline. The Habitat for Humanity house being built in Memorial Park is almost finished, Sandy Hopkins, CEO of the Winnipeg branch of Habitat for Humanity, said Monday. It's being readied for is an overnight move June 15 to its permanent location at the former Sir Sam Steele School site on Nairn Avenue. " We're slowing it down," said Hopkins. " We're not working ( Monday), but we are ahead of schedule." The one- storey, 840- square- foot house is one of 28 Habitat will build in Manitoba this year - 22 in Winnipeg alone. Rene Van De Keere, his wife Shannon and children Brendon and Cadence will move into it near the end of the year, after it's placed on its new foundation and its interior is finished. The family qualified to buy the Habitat house after they met Habitat's criteria to handle the mortgage payments, a process than can take as long as a year. There is no down payment, but the new owners must complete volunteer work prior to house possession, which is 500 hours for a two- parent family and 350 hours for a one- parent family. " The sweat equity must also be completed before they can purchase the house," Hopkins said. " We don't deviate from that rule." He added Habitat gets about 500 inquires a year from Manitobans interested in a Habitat house. Many are turned down because they're either on social assistance or earn too much income. Habitat is also building the first 10 of 20 homes at Main Street and Fernbank Avenue this summer. The second 10 will built in 2013.
